You cannot.

If your brother meets the US presence requirements then he may have transmitted US citizenship to his child at birth, and would be able to do a CRBA; it would depend on whether he met those or not.

So do you know what is the requirement. If my brother meet those requirement? what is the next step? what Forms should my brother apply?


He is citizens since 1995. His individual income is over 60,000 and he is single. For sure that He pays tax every year.

Had a child and never married? That complicates the process. Does he already have a Vietnam birth certificate with both parents names on the certificate. As stated there need to be 5 years physical presence in the US to pass along citizenship. One of the forms will ask you to put dates residing in the US. As long as these are close there should be no issue as the embassy has instant access to all entry and exit dates of your brothers passport.

I'd be more concerned about proving parentage if he qualifies on time. This embassy loves photos. Don't bring a photo album as it won't fit under the slot at the window. You'll need the birth certificate, medical records of the birth. Any documentation proving the mother and father had a relationship at time of conception. You don't need any tax info as this does nothing to show parentage.

This is all done from the US embassy in HCMC. Both parents and the child need to attend to attend to issue the CRBA and passport with the SS card to follow a few weeks later.

Go to the HCMC US consulate web site and follow the CRBA instructions. This embassy has very good online instructions.

I did this in January at this consulate. Both parents must be present to issue a child a passport. I could get the CRBA and the SS card with one parent but they require both parents to get the passport.

In some cases it's impossible for both parents to appear, but a US citizen child is still entitled to a passport.

From the website of the US Consulate in Ho Chi Minh City:

"If either parent cannot be present, the appearing parent will need to provide either a photocopy of the non-applying parent’s ID and a notarized form DS-3053 Statement of Consent or form DS-5525 Statement of Exigent/Special Family Circumstances, depending on your circumstances."
