Timeline

My fiancee arrived on 12-24-06. She was refused her ssn about 12 days after she arrived. We were married on 1-12-07. She was refused her SSN again on 1-16-07. She was told she needed to go to INS because of the name change. Today she had an appointment with INS. INS said she can not get any kind of SSN until after we file papers. Everything I have read has contradicted what INS and the SSA is saying. She should at least be able to get a not authorized for work SSN. I would like to at least put her on my insurance but I do not think that is possible without a SSN.

I applied for my SSN 2 days after I got married. I took a certified copy of our marriage certificate and my passport to the SSA office and had no problems getting a non work-authorized SSN.

I applied my SSN 2 weeks after my arrival here. We first went there to apply a week after my arrival but the SS people said my name isn't in the system yet so we were asked to go back after a week & so we did & I was able to apply for SSN.

I applied for my SSN after I was married, in my new married name, about 12 days after I arrived in the US and received the card without any problem. I took my passport and marriage certificate, explained that I entered on a K1 and subsequently got married and by the reaction I got (as in, none), this seemed to be pretty normal. Seems to be a lot of confusion in those offices in regards to what the protocol is. Maybe try another office? Bring all the information you can find that says K1 holders are entitled to an SSN. Print the following webpage out (K-1 Visa Holder Only); pay attention to section C:

you are specifically looking for what is under c-1:

Class of Admission..............Description

K-1.....................................Fiance(e) of U.S. citizen

print that out and take it with you to the ssn office. maybe someone there can read....

note that nessa got her ssn card in her married name without the hassle you've endured. perhaps a different office might be your best bet.

I added my wife to my health insurance while she was waiting in Medellin. I suppose they may vary from company to company. Ask and be persistant. My credit union also refused to add my wife to my account saying that "according to Homeland Security Act" she had to have a social security number.

I read it and what they actually say, Is that the financial institution must establish a CIS or Customer Identification System. The Act also go on to state that a valid passport from a foreign country is acceptable. They put her on the account.

She should apply for her SS card in her maiden name, without mentioning that she has married. That should avoid the problems she has run into at her local SSA office. Such problems are common at many SSA offices, although not at all offices.

A SSN is not necessary for you to add your wife to your insurance. The insurance company can create a number in the proper format to use to identify your wife until such time as she does obtain a number and you tell the insurance company what it is.

We had a similar problem with the SS office in our town. It seems that individual offices interpret the law as they seem fit. We were unable to get my wife a SSN until after we passed the AOS interview. By the way, you need to apply for EAD to get her to work, but why do it. They confiscated my wife's EAD at the AOS interview.

I maintain that people who are not smart enough to work at Social Security are hired by USCIS.

I think this is standard practice, if you are approved and a card is ordered.
