Hi,

We finally received notification of our interview date - 20th February - and I am finalizing all the documents for my husband. Last September, I went to the IRS at the Embassy in London to file my tax returns for 2003/2004/2005 as I hadn't been aware that I should have been filing the entire time I lived over here (over 5 years). I have stamped copies of each from the IRS to say that they have received them.

I was reading through some forums and someone posted that if you filed your returns late, you needed to include a transcript of them with copies of the returns. I have just rung the IRS to request copies of the transcripts, only to find out that the returns were never filed! :o

Has this happened to anyone else? I will be going back to sort this out with the IRS, but if it is not resolved before our interview, will the stamped copies that I have of the original 'filing' of the returns suffice? Any advice would be appreciated. Thanks!

Kimberley,

When I filed my tax returns I did 3 years altogether, as I wasn't aware that I had to file.

They returned some copies to me with a stamp on them and the date they received, I called and asked if those were good enough to show to the Officer at the interview and they said yes.

Also, I am not sure if you are aware, but you will only need last year's Tax Returns.

Hope this helps!

Anyta - thanks for your reply! (sorry I didn't see it as an email notification didn't come through!)

I do have the stamped copies of my returns so that should be fine. But since then I have contacted the IRS in London where I filed and they told me that my returns had been mistakenly filed against my husband's ITIN and I have to fill in a form to resolve that. At least I have proof that I did file! What a mess. Thanks again!

All you can do is take what you have. If you have any official notice of your returns not being forwarded by the London office, take a copy of that.

My gut feeling is that it will not be a deal-killer, FWIW.

Thanks! I have the copies of my returns stamped by the IRS at the Embassy when I submitted them, so I think that should be okay. Just to check, although I am working in the Uk and my income will not be considered for sponsorship (I have a joint sponsor) I have put my income on my I-864 so that it matches what I have put on my tax returns. Is that right? I don't think that I should put 'unemployed' etc because that's not true, although I haven't been working in the US.

sorry for all the questions, our interview is on Tuesday and I'm in a panic.
