While on vacation in Sarasota recently, I had two conversations with individuals that has their dates backdated when they received their greencards. So in effect they had also been fulfilling their time for naturalization concurrently.

Has anyone here had this experience.

It can only be dated from the date you were approved at AOS interview.... under what catagory did these people get greencards??? work?, loterry? for us marriage based applicants it is from the date of AOS approval...

They were all family based and they did have the dates substantially backdated. This was in the Tampa office.

That's interesting to read. I was wondering, and I know this is jumping the gun somewhat, if my son's AOS is ever approved whether or not they will backdate it to the date of his interview. It seems unfair to have someone in the system for 4 years, arguing that they are entitled to AOS. If that applicant is proven to be correct, they still have to wait a further 5 years until they can apply for naturalization. That doesn't seem fair.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!

I agree...however, "fairness does not enter into the equation what so ever" Is it fair for some to receive rapidly and others to have to pay renewal fees year after year?

Although it took an extra month to get the email approval and the actual card, my wife's green card was backdated to the date of interview. We were happy not to have been penalized for USCIS losing her biometrics.

What were the 'Resident Since' dates on the Green Cards? If there were interviews, what were the interview dates?

Your wife's application may have been approved on the day of her interview. Was there something said during the interview, or was there correspondance following the interview, that makes you think that she was not approved until some later date?

Our case was continued for supervisor review after the interview. We then got a notice telling her to appear to have her biometrics retaken. We got the email approval about five days after the biometrics appointment. My guess is that the supervisor approved the case on the day of interview pending collection of the biometrics.

My guess is that the supervisor approved the case outright, not pending anything, in which case there was no 'backdate'.

Was the re-done biometrics that you write of a photo and index fingerprint, not the set of 10 prints that gets sent to the FBI?

I'm sure I have seen some sort of information on te USCIS site about applying to adjust the date on a greencard, but I am too lazy to look it up.

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

I didn't ask. I was very curious and would like to have asked; however, it seemed beyond the boundries of polite cocktail conversation. Personally I have my doubts, but the individuals were emphatic. Of course it was New Years eve and the aguardiente and cervesa were flowing freely. In addition my spanish is only intermediate at best and latinos speak very fast under the influence.

Just looking for outside experiences in English.

My guess is that the Green Cards were properly dated as of the date that status was granted. Although typographical errors in preparing Green Cards is not unheard of.

I agree since no one has posted a similar experience. The other "probability" is that they were just plain wrong or we weren't communicating properly. I was basically just a hopeful post.

It is frustrating to have to wait so long for AOS most will be citizens before my wife is issued a green card.

On the bright side she is by my side.
