Hi All,

I could not find the answer to my question in the former posts, so I ask it here...

I came in the US under a K1 visa. I got married on 6 Jan 07 and I have just sent an application for AOS. Can I go to the DMV and pass the driving licence test before I get an approval for AOS? My French driving licence is no more valid since I have now spent more than 3 months here...

Check on local regulations but most States will allow you to get an ID or permit/license but with a K-1, it will expire 90 days after the POE set on the I-94. State gov want some piece of paper from the USCIS that states, K-1 status valid until xx-xx-xxxx. You could wait for the green card which would give you two year or get the EAD card which would give you one year.

Biometrics completed Nov 5 2004

EAD Approval Dec 29 2004

AOS appointment letter received Feb 3 2005

AOS interview scheduled for March 9 2005

AOS interview mostly fine, just need I-693 supplement filled out by civil surgeon

Spend another $40 for I-693 form, sent to local USCIS office registered mail, arrived March 11 2005

AOS finally approved March 25th 2005

Green card arrives about 10 days later

!!Green card has incorrect middle name!! Thanks USCIS

Travel back to Denver, turn in card and I-90 to correct their mistake.

Application accepted, asked for I-551 stamp, they told me "We don't do stamps anymore"

NOA1 for I-90 received from NSC April 18 2005, fee waived

NSC appears to have stoped processing I-90's

Marilyn needs to travel back to the RP, call Senators office for help with green card or I-551 stamp

Travel back to Denver July 1, 2005 and received I-551 stamp in the passport.

Great question! That hadn't even occured to me, although I am still in the early stages of the K1. I don't know your location, but here is the info for Illinois (my state). Perhaps it's similar in other states, I'd Google your state DMV to be sure.

Met online February 2006

Went to England on working visa June 2006

Sent off I-129F October 2006 <3 <3 <3

In England until visa expired December 2006

We leave England for a stateside Christmas December 17, 2006

Karl goes back to the UK January 7, 2007

I make a scene at the airport January 7, 2007

I head back to the UK to wait it out with him February 9, 2007

I also came here on a K-1 visa, and tried to get my driver's license a month ago. Two DMV offices I went to here in California refuse to issue a driver's license if your I-94 is valid for only one more month from the time of application. They say you need two months on it. I don't know what DMV's policy is at your home state, but if I knew this was the case, I would have applied for my DL as soon as I got here. Now I have to wait for my EAD or Green Card before I can drive.

In Oregon you just need valid ID and proof of recidency here in Oregon, and they gave me a 8 year drivers liceanse.

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

Hi Audrey and all the kind listers,

I am in San Diego and same problem for me, they would not let me pass the test since the K1 was not valid for a period long enough... I will read the local DMV policies and maybe try to go back with the NOA for the AOS and the wedding certificate... Hopefully I have alittle chance they will let me pass the test... What do you think?

DMV requires that you show some documents indicating legal presence in the US, and the NOA1 for AOS or marriage certificate in not one of them. I didn't try asking about those, but the way I see it, if the requirement is not on the list, they won't accept it.

I have my US (South Carolina Driving license)

In SC if you obtain it before you get married you have to haveI94, visa and proof of residency, they also asked for the Notice of Action for filing for your Employment Authorizion it took me 1/2 hour to explain that I don't get that until AFTER i'm married

They advised if I waited until after we were married I would have to supply Marriage License, Proof of Residence, and NOA for Employment Authorisation

I tried to change my license to my married name last week and they wouldnt amend it until I have filed form AOS

Yes, the rules vary from state to state. Be sure you read up on the laws in your state. We have been told a different story each time we call or walk in the DMV. We have been told anything to that he cannot get his license till his green card arrives and then last week were told yes he can get a license, it will just expire when his EAD expires. I'm def going with him next time in case they try to give him trouble again.

I checked out Pennsylvania's requirements and the website said US Citizenship should was required. I called and they said K1 visa holders need the following: Passport, I-94, Soc SEcurity Card, Marriage Certificate, Proof of Residency(utility bill, name on a lease, etc), and proof of spouse's citizenship.

08/31/09 Check is Cashed/Clears

08/27/09 NOA

09/24/09 Biometrics

11/24/09 Approval letter arrives!

Unfortunately, California does not recognize NOA1 as a proof of legal presence, even though it IS a proof of legal presence. I decided that as long as I can't get a license I am not a resident, so I can use my Polish license.

Now I have a temporary CA license and am taking a driving test on Monday :)
