I spent two months in Florida this year when my husband and I first separated. I came back to no job, no place to live, nothing this was on May 16th. A week later I attempted to go back because his grandma had a heart attack. I was given the option to withdraw my petition which I did. This was 3 months ago. I'm now working at a steady job, however I'm living with a friend so no rental agreement. I want to go and visit for his birthday in October 28th. I have no rental agreement but I do have bank statements, employment offer letter, pay Stubbs etc. what are my chances of going for a week?

Also I will have a new passport. I believe I get a new passport number. I'm assuming that my info transfers over to the new passport? All advice and suggestions welcome!

Also if it helps my monthly income is about $2k plus commission.

Oh I'm from Canada btw

Yes, your previous denial of entry will be attached to your new passport.

I was denied entry as well, you want to expect more scrutiny and probably going to secondary inspection when you cross again. You seem to have stronger ties but it will all come up to the border agents.

He and I joke a bit about somebody's chances of getting a tourist visa or being admitted....I think your chances are slim, but not impossible. Pluses: not many right now

minuses: short term employment (thus getting a paid vacation so quickly seems unlikely), no house, property, a recent denial of admission.

I was allowed to withdraw my application for entry into the US. At that time, I was told to not try for, at minimum, 6 months and that I'd better bring a ton of evidence of very strong ties to Canada before they'd let me cross again. And that was true. The next time I tried, I brought my lease, a letter from my job stating they knew I was going to visit my husband and would be back in 2 weeks. I had my car loan docs, my insurance papers, my son's doctor appt letter, proof he was enrolled in school.

It all depends on the day the officer that processes you is having but I'd say you should def. bring stronger proof or be prepared to be turned back.

I was denied entry twice within three days. But then admitted a month later.

It depends on what you can prove for ties and the agent at the time of crossing.

Thanks everyone for your helpful replies this far! The one I'm stuck on is the apartment lease agreement. I'm living with a friend because of a bad credit history. The nature of my employment (collections) enables me to be able to receive time off as long as I put in the time to make up for it. My boss is willing to let me take the vacay time as long as I make up hours which is doable.

There are two outcomes, 50/50, you get in or you do not.

Within those outcomes there are sub sets, you could get a normal entry, you could be paroled, you could be allowed to withdraw or deported.

What amuses me is that people coming on here providing often very little information and ask us what the chances are of one particular outcome.

The only absolute certainty is if you do not try.

Suggestion : Apply for an enhanced drivers license for transit into the US

The content available on a site dedicated to bringing folks to America should not be promoting racial discord, euro-supremacy, discrimination based on religion , exclusion of groups from immigration based on where they were born, disenfranchisement of voters rights based on how they might vote.

one cannot be deported unless one is (a) first admitted or (b) has entered without inspection [EWI]...being denied admission is NOT the same as being deported, as deportation can only take place if an alien is INSIDE our borders, not outside, awaiting the decision of our border officials....(yes, a technicality)
