I have browsed the threads on this forum for a few times, and I am still overwhelmed by the information. Therefore, I hope someone can help me to realize if we need a lawyer at this stage.

The reasons why we think we need a lawyer:

(1) My husband-to-be is a U.S. citizen, and he just started his work this February. We are not sure if he will meet troubles while being asked to submit the IRS tax reports for the past 3 years since his past income might not be high enough.

(2)We stay together now, but his company might send him away to other customer companies for 6 months or 1 year soon, which might make the whole process more difficult, so we want to find a lawyer, in the hope that the lawyer can tell us what to do with this situation.

(3) I am waiting for the approval of my H1-B, and I am not quite sure whether I can start to apply for the change of status.

We will appreciate any experience sharing!

1. Current income is what counts. If he can show he is currently employed and makes over the amount then it is fine.

2. Is this abroad?

3. You can file AOS.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Thank you very much for the answers!

2.He might be. He is not sure. One of his coworkers is sent to South Africa this month.

3. Should I wait until the effect date (Oct.1,2014) of the working visa? I am worried that I might not be able to work if the work permit does not be sent in time.

Also, are USCIS Form I-485, USCIS Form G-325A, USCIS Form I-765, USCIS Form I-131, and USCIS Form I-864 all I need to send?

yes I know it, but thank you very much for the reminder! What I worry now is I don't know if my parents have English names/passports (their names are written in Chinese characters, of course), so I cannot pick up the marriage license before I get my English translated birth certificate...hopefully I can make it before the wedding ceremony.
