Couple wanting to move to Hawaii - American/Canadian

Hi there

I would be very grateful for some guidance as I don't know where to start.

I was born in the US, I have my US passport but I've lived in Canada since I was a child. My Dad is moving to Hawaii from Florida for health reasons. M boyfriend and I want to be near him and move permanently to the US.

My boyfriend of 4 years is Canadian and I have no idea how to get him in to the US. We plan on getting married.

We will be going with savings and planning to get a job once we get there. I can't sponsor him in or anything. We share a home together here in Canada.

Any advice appreciated.

Hi Linda,

You should take a look at this post on VJ, It will give you a brief comparison of how you could bring your boyfriend here to the States Most likely the fastest way to bring your boyfriend here would be the K1 fiance visa, but some people have experience delays, so read thoroughly and see what makes sense for the two of you :-) Good luck!!!

Look through the link provided by the previous poster and read through the Guides section of this website (link at the top of the page) and read about brining family members of US citizens to the US.

For your boyfriend to move permanently to Hawaii without a job, you'll have to be prepared to get married.

He can get a fiancé K1 visa and you'll have to marry in the US within 90 days of your move.

Alternatively, you can get married in Canada and he can apply to immigrate as your husband.

Both of these require you to sponsor his immigration. If you don't make enough money to show you can support him, you can add a co-sponsor.

If you're not prepared to get married, he'll have to get a job in Hawaii first. His employer would have to be willing to sponsor a work visa, so he'll have to have some skill they're looking for. The visa most people use is the H-1B but as a Canadian he can get a TN work visa which has to be renewed every year, but which most employers find much easier and more affordable to sponsor.

Finally, if none of that works for you, he can visit the US on a limited basis, but he won't be able to move here. Note that if he stays too long or visits too often, he may be denied entry in the future.

If you make good equity from the sale of the house (over 60k USD) you could sponsor him based on assets. You would not need the assets until the NVC stage of the process for a spousal visa (or the interview and AOS stage of a K1.)

Cr1 may be easier on you as a couple. E cause he could work upon immigrating. K1 has a 60-90 day wait period after you file the adjustment of status after entry and marriage.
