Next week my wife and I are going the US Embassy in Seoul to file our I-130. We have been married for about 3.5 years here in Korea and just 1.5 years in America.

So my question is do we file both marriage certificates and will we be able to apply an IR-1 visa instead of a CR-1 Visa.

Married is married. US accepts marriage performed in other countries as long as they wouldn't be illegal in the US (bigamy, for instance). There was no need to get married in the US, and since you were already married, in some areas, getting married again would have been illegal.

Your original marriage is your marriage. Good luck.

Translate and file the first one only. They will issue her an IR1. Good luck!

This might be outside the scope of this forum and is not something I know, but does the poster need to do anything about the second marriage? If so, is there anywhere he/she might look for information on what to do about it?

It seems that there might be an issue if a routine check returns with the public record of another marriage on the books for this couple. (Edit: Or maybe it wouldn't be an issue. As I said, I don't know. Seems something worth looking into, though.)
