Basically my wife is planning to change her last name to mine and moving her last name to her middle name (which is allowed according to the Social Security office without going to court to change it). She is the US Citizen.

We have already filed the AoS/EAD/AP paperwork nearly a month ago, still haven't recieved my biometrics appointment (which is a different issue)

So do I need to inform them when she changes her name or should I tell her to wait til after I get my Green Card (although could be an issue since we travel a lot so don't want to not have her passport because of a name change after I get AP).

Any ideas on what to do? Only seems to be a way to change your address on the website...

Also have a son now (after filing).

Since you are the one applying for immigration benefits, I don't really see the need of your wife informing the USCIS that she has taken your last name. Your cards will still come. They know you got married. I think they only care about your name really.

She can travel fine with her maiden name passport. Book the international tickets in the passport name for less delay at the airline counter. Or take a copy of the marriage certificate to show why Passenger X has a passport called Passenger Y. Or get a new passport. Have you checked to see if the name configuration she wants is allowable on passports?

I use various versions of my name on official things like driver license, passport, stock certificates, bank accounts. Some have First Middle Married and some have First Maiden Married.

Seeing as OP is adjusting from K1 - the petitioner will be listed on OP's AOS forms as the person who petitioned for the I-129f- should OP include a declaration of name change married/maiden surname so that the officer knows the petitioner is the same petitioner during K1?

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

07-11-2022: Naturalization Interview

My thoughts are adjustment of status is a brand new process. The K1 is over so I wouldn't worry that they are going to be fretting over who petitioned or flipping back through the fiancé petition. If you, sweetswinks, take your husband's name, then when you adjust you will use a different name on all your forms. They aren't going to be thinking it isn't the same person he petitioned.

And I think they are smart enough to know if Mary Smith married James Jones, it would not be unheard of to think that she might be called Mary Smith Jones. I realize he must have filed his papers using the USC's maiden name is why the question. I just have the opinion that it is not a deal breaker, whereas if he filed under a name he did not want on his greencard, then they need to change something because he is the immigrant. Strictly an opinion that if it was me, I wouldn't worry about it, but I'm not a worrier like the British tend to be. :P.

They have already filed for AoS etc before the name change so I see no reason to tell anyone. It's their business.
