Hi all,

Please bear with me as I explain this two-part question.

1. I am a Canadian working and studying in the UK. We plan to file the application for the K-1 while I am in the UK, are there any complications/extra headaches around applying for this visa while living abroad? I work in the UK on my EU (Czech) passport, but I would like that visa in my Canadian passport, so that I can enter the US as a Canadian.

2. Please don't judge me here: it's our second time applying for the k-1 visa. Quick background: we met in school in Europe in 2009, and this September we will have been together for five years (we lived together for 2 years overseas). I entered the UK on my K-1 visa (obtained from Vancouver consulate) in October 2013, and it was probably the worst timing ever for us. He lost his job and was unemployed, i was accepted into a graduate program in the UK, and we are both career-driven people (there were a few personal things too that we have since worked out), and so we decided that it was not the best time for us. So I left (after 2 months) and informed the Vancouver consulate. Looking back, I am not sure it was the best decision, but we have to live with it now.

We want to time this visa so that it coincides with me finishing school the summer of 2015.

Can anyone please advise if USCIS/immigration will look at us unfavouably? Is there a greater chance of getting denied at the POE? The visa is with the same person, we are pretty straight forward (no kids, no divorce, he makes enough etc...)

If your last I-129F petition was approved less than 2 years ago, you need to include a request for a waiver of the filing limitations with your 2nd petition. Other than that there are absolutely no issues.

My last petition was also my 2nd petition, and I needed the waiver request. My petition was approved, fiancee's visa approved, POE was quick...and all with absolutely no problems.
