Hey guys first post on this forum. And we have a bit of a doozy!! I was a CEO overstay. By approximately 6 months we were going to file sooner but my wife got pregnant insurance didn't cover maternal stuff and we paid it all out of pocket thus delaying application. The wife was working earning enough money but got terminated due to her not being eligible for family medical leave act. I now my self have a job offer but no ead I know it's been like 10 days but I had gotten an email from the USCIS saying I'm due to be schedule for an interview which now worries me with my wife not working. Can I expedite the ead? Does my wife have to go back to work? Would my earnings count towards anything? Any advice would be greatly appreciated and sorry if this is in the wrong area of forum.

I made a little timeline below

USCIS received our application To adjust status on July 8 2014 I have had Biometrics on 5th Aug 2014.had

13Th Aug apartment went to scheduling and interview.

Oh and also my priority date says it is 8th July 2014.... Any ideas?

You can expedite your EAD because of a job offer.

Expedites do not take the 2-3 months it takes to get the EAD anyway. If they did, why would it be called an expedite?

Guys those are great answers I'll probably. Call the uscis tomorrow and ask for an expedite: ) but in relation to my other questions? Any advice my wife is the USC who lost her job

I have never worked in the united states I came here on vwp last year in July. And I am not sure the exact date yet still waiting on the letter all I know is it has moved into scheduling and I had an email from the stating I'll receive a letter in the post within 30 days to confirm a date for interview.

If you have your AOS interview before you start your new job with EAD, then you have to use a joint sponsor for I-864.

Your USC wife will be still the main sponsor even though she is not working currently.

If you are already working before the AOS interview, you could present a updated I-864 that include your income and supporting documents(W2 form, pay slip, letter of employment..etc) during the interview.

(provided your new job income is above the poverty guideline for your household, otherwise you may still need a joint sponsor).

One final question. Without expediting can you or anyone e estimate how long I'd have left to wait for my employment document and how much time if I did expedite?

Is that from my Biometrics date or the date the USCIS received my applications? And with expediting how long does that take. I am just trying to see if it is worth waiting or expediting tomorrow morning

It is from the date of filing. Someone that recently had one expedited said it took 42 days from filing, so it cut the time by about half. Well I requested my ead expedite spoke to a lovely lady and was told it will take 30 days to hear anything didn't get asked for proof of a job offer is this all normal what will the next steps be? Thanks
