Confused on DS-3025 & I-639...

It seems this may be kind of common for certain medical exam facilities in China.

Here is a very fresh thread on Chinese fiancee not getting the Tdap (our's was TD),

and they received RFE, and looks like they were able to get the shot

and I-693 without doing full medical...in HOUSTON...so I will see if I can

go through the same CS. So it may not be too bad...we will see.

It's unclear to me what triggered houston100's RFE from his posting.

Did he receive the RFE because he did not send in the DS-3025 or was he actually missing the required shots?

We know of 4 K-1 cases with Chinese fiancées including ourselves who had no issues at AOS by just sending in our DS-3025.

The USCIS accepted our DS-3025 from China with no requirements for booster shots.

My then-fiancée received 3 shots the same day in Guangzhou: Td, MMR, and Varicella in 2011. These were recorded in her DS-3025. Her DS-3025 result section had checked marks in the boxes: "Vaccine History Incomplete", and "Applicant may be eligible for blanket waiver..."

A few weeks ago, another friend of ours had a child come in with an IR2 visa. The child's DS-3025 had the same boxes checked. Tdap was not given to the child because it was not available in China. That didn't cause any issue with immigration. However, the child's school in the U.S. requires Tdap for enrollment, so they went to the local Health Department for the Tdap shot, which had nothing to do with the USCIS.

Bobby, I think the difference in your case is your fiancé actually got the Td shot. She was for sure as complete as possible on that date. She couldn't have the extra doses that same day. The child getting a true immigrant visa wasn't going to go through AOS. He would be a permanent resident the day he entered the US. so at his interview in China was his only chance to pass or fail immunizations. There was no Tdap available. The Dept of State says immigrants are not to be held up waiting for a shot or making multiple trips for boosters. His shot was waived for not being available.

Then there is Duality whose fiance's K1 visa is non-immigrant. She got nothing for the Tdap/Td/DTP (any variation). She is technically incomplete. His fiancé can get Td in the US before applying for AOS. So the statement-- MAY be eligible for a blanket waiver is just that. The person looking at her file MAY accept the excuse "not available" without blinking an eye. Or he MAY say she could certainly have gotten the shot in the US before filing. I would skip the civil surgeon and roll the dice. The worse that could happen is being sent to a civil surgeon, right? The best that could happen is getting a greencard without the hassle, time, or money spent on a civil surgeon. His decision.

The issue with I-693 alone may be convincing enough for someone to consider filing for CR1/IR1 instead of K1

I have few weeks before she arrives to ponder about how we will roll this dice.

Like you said, the worst case if we just submit as is is we have to get the shot and go visit CS.

Thanks for all the information. In my city, there are only 3 civil surgeons available. If I ever need I-693, I don't have much options to shop around.
