I-131 Approval & Processing Time

My spouse needs to file this for travel>1 year. Lawyer (friend) says that it is always approved (assuming that you already have a valid green card) and that she has never seen one denied. Just checking, (I always check on what lawyers say ;-) ), does that sound right?

Also, what is the processing time for this after filed. She plans to file it online.

TIA for any/all responses/help!

Presumably you are talking about a re-entry permit, which is one of a number of purposes an I-131 is used for.

Then yes, they are usually granted routinely, and are required if a green card holder wishes to remain outside of the US for over a year but less than two years. You should be aware that CBP may require proof that you have not abandoned your residency when you return, even with a re-entry permit. Such proof might be: continuing to file US income taxes; having maintained a US residence, mailbox, driver's licence, insurance policies, bank accounts, etc. Equally they may just wave you through on the back of your prize-winning smile; you won't know until the day.

Currently listed as 3 months on www.uscis.gov

Your application will probably be sent to the Nebraska Service Centre.

You can request that the re-entry permit be sent to a foreign US embassy though, so are able to leave as soon as you have had your biometrics appointment.

3 months for such a simple application. The government gets slower every day! ;-)

I'm also looking to see if there are any recent applicants who can give some actual processing time data.
