Do I still need UAE Police Clearance Certificate if mother isn't living there anymore?

Hello,

My husband has applied to bring his mother to the U.S for immigration from Pakistan. Currently, we just got the email to fill out the DS-260 application online, and I just got through filling that out and adding myself as an agent. (will this make it so that I can actually call NVC myself regarding the case in addition to my husband (petitioner) and his mother(beneficiary) ?)

I don't know whether the AOS bill is available to be paid just yet however, seeing as frankly I have completely forgotten how to find out whether the IV or AOS fees are payable...I used to know how, but it's been a while since hubbies case.

My question is regarding a UAE police clearance certificate for my husbands mother. I read a few people on these forums suggesting that you can only get those in person at a Police Office, which would mean the beneficiary would still have to be there. I also read in those same topics how people still got their visas approved without the certificate for UAE, just sending in the one for the current country the beneficiary is living in.

My MIL lived in UAE for 3-5 years 25 years back. She hasn't been there since. I honestly have no idea how to obtain a PCC for her from there in person or otherwise...it seems impossible seeing as we certainly can't send her over there just to get one, that makes no sense. I was hoping someone here could tell me that it is not needed in her case and we'll be just fine without it because frankly, we've got all of her other documents in hand right now, and could send in both IV and AOS packages the moment they're paid as it is! I'm pretty confident this UAE PCC is going to take a long while to get our hands on, if at all possible! That is very disconcerting to say the least.

But if it is not likely that we can get away without that darn UAE PCC, does anyone know how we can go about obtaining it, and expediting that process somehow? My MIL's brother-in law lives in Dubai right now, is there anything he can do if it is a must for us to have that PCC for her?

First of all, she cannot get away from it. Her case won't move on until she provide that police clearance.

She needs to contact the UAE embassy/consulate in her country. They will tell her what to do to obtain the police certificate. (Exemple, from Canada, to get a police clearance from Japan, i need to go to their embassy in Montreal with my passport and an other form of ID to request it. They send it to Japan then when done mail it to me. Takes about 2 months.)

Ok. Should I still pay the AOS fee now that I have been notified that it is available to be paid even if I don't have the IV packet ready to send when the time comes to pay and send those in. Should I pay aos fee and send in the documents now...even if it may take up to 4 months to get my hands on that UAE pcc to complete the IV packet? Or should I pay the IV fee when available to me, send in all other documents I have...and wait to get my PCC...and risk an RFE requesting for it in between, but at least have sent the rest of the stuff?

Hi MumtazG38,

The link to check if you have any pending fees to be paid : https://ceac.state.gov/CTRAC/Invoice/signon.aspx. You can simply enter as Agent in the drop down menu, enter the case number and the invoice ID number. You are good to go!

Now regarding the UAE PCC, I went through the same dilemma, few months back while I was in the middle of this DS-260 thing. The good news is: You don't even need it! since the UAE police won't issue the clearance certificate unless the applicant is physically present in their land and it is regarded as unobtainable in the USCIS reciporicity procedures. My recommendation is to go ahead and send the civil documents soon after you finish the online DS-260 submission. This will save you al lot of time, not to mention the fact that NVC correspondence is incredibly slow and unreliable! Well, atleast as per my experience, my wit and charm never worked a thing with them :)

Also take a print of the USCIS "Police Records" section in the link i provided above, just in case the consular at the interview asks your MIL about it.

Kwasti is right, UAE will not issue police clearance if the person is no longer residing here, USEM is aware of that, goodluck?
