RFE HELP!

I filed my AOS last month and today I got a mail from USCIS for RFE. It's saying that I need to submit all the supporting tax documentations. My husband doesn't file tax and he's getting SSD and that's his only income. He doesn't have bank account and his only asset is his truck. It's saying that he did not meet the poverty guideline. Now my only option is to have a joint sponsor which will be his mom but she don't file tax either. Can somebody tell me the right thing to do.

You need to look for another family member or close friend that can meet the requirements asap. This is the only way to get your approval. Good luck

Well his mom can meet the requirements but she don't file taxes

Does he meet the 125% requirement for your household size through his SSD? Did you send proof of his SSD income? Did you provide a statement as to why he was not legally required to file? The I-864 instructions state you must provide an explanation as to why you were not required to file. Sometimes people with non-taxable income need to provide extra proof of their income, since it does not show on their taxes. A Social Security benefits statement, SSA-1099, and 12 months of bank statements to show the income deposit amounts each month should be used for proving the income meets the requirement.

No they said that he didn't meet the poverty guideline. And yes I sent proof of his SSD and yes we sent an explanation why he don't file taxes. I guess we will just have to find another co-sponsor

How much is his income and what is your household size? They were asking for taxes, so they apparently overlooked your statement about not filing. They also will state you did not meet the requirement if you did not provide enough proof of income.

The sponsor must make $19,662 per year to sponsor a themselves and one immigrant. Does mom live in the same house as you and your spouse? How much does she receive?
