Camelott please double check with USCIS. Also, do as a previous poster suggested and call congressman. My husband and I were told our file couldn't be found. Eventually, it was found in Oklahoma by the congressman. I am so very sorry. The mix up caused us to have to wait 11 months for NOA2.

I agree with all of them. You should try to find it, Beside it contains sensitive information, also maybe trying to find it going to be shorter then filing it. Please just contact your congressman, do research on this site and see sometimes congressman can solve your prob, at least they help you as much as they can. Anyway, your case is same with me, its been sitting on embassy since May 5th (Proven from DHL Express tracking number) but embassy and NVC both insisting they dont have it. In my case, my USC husband keep emailing and contacting NVC and embassy these days, we give them time and after a while we are going to involve congressman.

"Oh well, we'll just file again, pay the fees again, hope it goes better this time" - ? Remarkably relaxed attitude. ...but if you've gotten responses for the first set of filings, you're gonna need to get that taken care of, pulled, revoked, or whatever, before you file again.

Exactly what I was thinking. I would be creating a hovac if they'd lost my file. This isn't a joke..

They did the same with another filer, but she contacted her State's Congressman and in 2 days they found her case. Instead of them shipping it to NVC..they shipped hers to National Records Center...that might be your case!! So, do contact your State's Congressman for help!! :)...It's not only hers..others have had the same issue.

Basically USCIS never admits that they have lost the file, that makes this case unique, even if USCIS lost file, they will cover it up by saying that they have mailed it out dated this this this, that's why i am saying never heard of it.

Even in your case no one is admitting the mistake, that's why your case is not same as of OP.

Sure they dont admitted their faults as always. Just as what i know so far embassy lost my petition (same like another 9 petitions that i and my husband just found out today). In our case, after myhusband got involved congressman then we got DHL Express tracking number and we can prove it to embassy that we are right. Today they told myhusband via phone that they will send email next week (give them a week) to figure out where is the petition. As long as you can prove it (that hardly to get it), you can talk to them more and get a better answer. Note : No visa story is same one another, sure, mine is expedite one since myhusband had PCS Order back in 2013, but see ... people says its short one, unfortunately its not working in my case (been 9 monts now)
