Hello guys. Here is my questions. I have all the last 3years tax paper but the recent one I filled was when I got married and I share the same name with my spouse now but on the tax papers it say am single and am married because when I was filling it says if am married I can fill separate or joint and if I file married and I file separate or joint it request for my spouse SSN and which my spouse is not even here yet in the U.S. So no it says am single and I filled separate but my name has change to my spouse name on it which makes it different surname from the last two other tax papers. Now is it ok or is that a problem when is time for his interview and they see I share his name and we married but the recent tax paper I filled last says single.

No, it's not OK - when you're married you have to file married regardless of whether your spouse is here or not. Filing may actually be a red flag.

Pay stubs - yes, That's the proof of your recent income which is the one that counts. They could care less how much you made last three years, what they're interested in is how much you're making now.

You can amend your taxes. You will not be able to file them electronically, you have to print them and mail them. You can amend them as well.

If you do not have pay stubs I suggest a letter from your employer stating who you are, where you work, how long you've worked there, what your position is, and how much you make per year.

No. We have an entire tax section here and there is the IRS website here. I have no idea how to amend taxes because I've never had to do it.

For Lagos they want to see that last year and this current year is above the line. If you put job on hold will you still be above the guidelines.

As far as your taxes and how you filed. Most CO's know we are clueless and didn't know we could file Married filing separate (when beneficiary lives outside of US) so amending get the 1040X go to irs.gov and read up. Or just leave alone and at interview state you plan to amen soon as you get to US and get SS#.

But you most definitely need to show this years in come above line or get a Co-sponsor.
