Freelance work with K1 Visa

Hi all,

I currently work as an Internet marketing project manager via oDesk for companies in the US, Australia and the UK. When I get to the US on a k1 visa, do I have to stop my employment for all those while I wait for my SSN and Greencard?

When you have entered the U.S. on a K-1 visa, you are not allowed to work there *until* you have permission to do so- either by receiving the (final) green card, or by applying for and receiving the EAD document, which is a temporary work permit until the GC arrives.

So, yes, I'd say you would have to stop doing that, *unless* that employment is actually handled through your home country- in that case, it would count as employment there, and you'd be reporting that income there, and not in the U.S.

If the employment would be "direct-billed" by you in the U.S., yes, that counts as "work", and you'd have to stop until paperwork is complete..

I have a bank account here currently in the Philippines that I can use in the US. If I work and get paid through my bank in the Philippines and withdraw in the US would that be okay? My other option is to get paid via Paypal from oDesk and pass it on to my fiancee and she withdraws the money.

I don't think its an issue as long as you are nt using your social security yet you shld be fine and continue working
