Hi all,

I am an Australian citizen about to head over to Canada on a working visa and also just recieved my 5year B2 visa so I may visit my partner who lives in the USA.

My partner and I have recently been discussing marriage so we can be together, no ring yet though.

I know that it is visa fraud to get married on the B2 visa but if we get engaged and apply for the fiance visa will I have to return to Australia and wait for the fiance visa to be approved or can I wait in the usa while on the b2 visa until the fiance visa is approved?

We have considered seeing an immigration lawyer but would prefer to do this ourselves to save costs.

Your input and personal experiences would be greatly appreciated.

I see no reason why you could not stay in the states on your B2 visa as long as you are staying within the parameters it allows you to.

Filing for a K1 and being here on another visa should not be conflicting interests.

If you were filing for the B2 the same time you were filing for the K1 then I would see a problem but since you already have the B2 I see no reason why you couldn't stay here.

I know a lot of people who came here on B2 and then later get married in US and then filing for Green Card with no problem..
