My fiance already received a mail from the USCIS last May and our petition is approved. My problem is the validity of the petition is only until September 8, 2014 but have not yet paid for the Visa fee because we are still saving for the it. We are planning to pay for the Visa fee this month. Is it possible that they will extend the validity of our approved petition? I need your help guys! :(

As long as the embassy knows you are actively pursuing the visa, they will automatically extend the petition for up to 1 year. If you pay the visa fee this month, then you are good and you shouldn't need to worry. A paid visa fee shows the embassy you are still applying for the visa.

The $240 for the visa because I insisted that I will help him to pay for it since he paid for the I-129f and will pay all the other fees

I see...that is nice of you.

However, if you are tight on money now and he has the money,

why not just get his help and pay for it and get the K1 visa progressing.

And after you come to US, you will have plenty of time and opportunity

to contribute to family income.

WOW! what a relief... i thought if the validity expires while were on the visa process the petition will all go to waste. Thanks zaydayn! :D I will also contact the US embassy to let them know that were on the process securing documents for the visa. Thanks again! :)

Apparently, some people are misinformed about the acronym AOS. With CIS the AOS refers to the Adjustment of Status. With the NVC and DOS, AOS refers to the Affidavit of Support.

The Adjustment of Status is the actual application for a LPR status, or "green Card". The fee is generally $985 with an additional biometrics fee of $85. There are certain exceptions for age. In the Adjustment of Status process, the Affidavit of Support fee is included in the $985.

USEM will automatically extend the petition validity up to a year (if you are activity pursuing the visa) so you have no worries.

You don't need to contact the embassy, they will AUTOMATICALLY extend the visa validity... no phone call needed ;)
