My fiance already received a mail from the USCIS last May and our petition is approved. My problem is the validity of the petition is only until September 8, 2014 but have not yet paid for the Visa fee because we are still saving for the it. We are planning to pay for the Visa fee this month. Is it possible that they will extend the validity of our approved petition? I need your help guys! :(

We will pay this month one at a time...

AOS has fees? Form Instructions say it has no fees

I am hoping that the Consulate will extend the petition.

Oh my :wow:

The fees are listed on page 5 of the instruction sheet of form I-485 here:http://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf

Yes the AOS is $1,070 in total for AOS + biometrics and if you file your EAD (to work) and AP (to travel overseas in an emergency) at the same time those fees are waived, so you pay a flat $1,070 for AOS, EAD, and AP all together.

How will you pay for your flight?

You can extend your petition. I am concerned that you have not researched all of the costs for this visa and adjusting your status.

Does your fiance make enough to meet the current income requirement of 125% of the poverty guideline to sponsor you during AOS? (for form I-864) for 2 people that would be over $19,662 he needs to be making right now.

Is it possible to secure the Permanent Residence or Change Status after we get married in the US? We will only file for the form I-864/I-134 since it is the needed documents for the interview.

The one who will be paying for my flight would be my fiance :)

This whole process makes our fiance bankrupt! I told him that his fiancee is so expensive that have to pay so many fees before he can marry. Haha.

To OP, sweetswinks is right. Another fee for AOS. :(

AOS Journey:

March 30 - AOS/EAD/AP sent

April 2 - USCIS received

April 9 - NOA1

May 6 - Biometrics

May 7 - Case is ready for interview

May 21 - Request for EAD expedite

May 26 - contact congressman for EAD expedite

June 1 - EAD card in production

June 2 - EAD approved

June 6 - EAD/AP combo card received

During your k1 you bring the i134 to the interview with supporting evidence.

Once you get to the US you will have to marry within 90 days upon entering. Then you must file AOS which needs for i864 and supporting documentation with it. Including the aos fee of $1,070.you send the form I864 with the AOS. Your fiancè need to meet the poverty guideline I mentioned in my previous post. How much does he make?

I am very worried that you don't seem to be aware of the fees and processes involves.

We will have savings by that time. :)

Thanks for you concern sweetswinks :)... I just don't want that my fiance will take all the burden of paying for the fees. We talked about 50/50 share since we will soon be partners (L)

Email the embassy and let them know you need more time.

Has your fiancé sent you the I-134? You will need this for the interview. Does he meet the poverty requirements on the I-134, in other words does he have an income of at least $19,662?

You are aware you cannot work when you arrive in the US? You have to file for AOS and the application for the employment authorization (EAD) is free when filed with or after the AOS filing. So you are looking at several months of you being in the US not working.
