Timeline

I got my NOA1 on 8/25. No NOA2 or RFE yet. It's been a terrible wait. I'm glad I made the decision to move overseas and wait together with my fiance at the time.

I am assuming you have a) residual income from a U.S. based business that exceeds the poverty guidelines b) meet the asset requirements in lieu of the income guidelines or c) have a joint co-sponsor?

Because unless you work online or own a business, I am just curious as to how you plan on meeting this requirement.

Hi All,

Thank you everyone for the support and the lovely wishes! Congrats to everyone who have gotten their approvals. To those who are still waiting, I'm praying for you guys. There is nothing I can say to make you feel better, but I will say God bless you all for fighting so hard for your loved ones. I mean, how many couples can say we had to fight the long fight with government to be with our loved ones, right? :thumbs:

Turns out I had not registered online to receive emails or text messages. I thought the initial forms took care of that. In any event, NVC told me to wait 35 days from the date of NOA2. It just never.....ends.......

I am now working on forms I-864, I-134, and DS-160. Having trouble with the forms, and would love your guidance and expertise. Specifically, on form 864, since I would need my mother to co-sponsor my fiancee, would I check my self as 1.a the petitioner, or 1.e the first or second of the 2 joint sponsors? Also, my brother is my mother's dependent and we all live in one house. Do I include my brother in part 5, line 5, stating "If you have any other dependents, enter the number here?" Finally, for the form I-134, can I show a joint sponsor? Do I need to show a joint sponsor for the purposes of an I-134?

I-864 is not for use with K-1 visas, you will only have need of this form once your fiancé is here, you're married, and you're filing for AOS. Only I-134 is for use with K-1 at this stage. Is your mother the cosponsour for the duration? If so, you will need to have her fill out the I-134 and send this and all the required evidence to the beneficiary for use during their interview day at the embassy. I-864 is not for use with K-1 visas, you will only have need of this form once your fiancé is here, you're married, and you're filing for AOS. Only I-134 is for use with K-1 at this stage. Much appreciated, friend! Yes, my mother is the cosponsor because I have just started my new job and my previous tax returns aren't too impressive. I now make $45k a year, but I believe from what I have read online, the embassy will only view the tax returns as proof of income and/or W2's. I will also be handing in a letter from my employer, but I do not know if the stated annual salary will be taken into consideration by the embassy.

Other than that, I would file 2 form I-134's - one for myself and one for my mother? Follow up with NVC to get an update on the case status, and then move forward from there. Right?

You don't file them anywhere. You send them and all evidence with them to your fiancé. They will present them to the embassy during the interview. You still have quite a few steps to go once you get the status from the NVC. Have a look at the K1 flowchart to get a feel of what comes next. http://www.visajourney.com/content/k1flow

$45k a year would certainly fulfill the sponsouring requirement for the I-134, however as far as I am aware, at least for my personal embassy only one person needs to fill out the I-134 (for the AOS forms then sponsor and joint sponsours would fill out multiple forms) and only an employer letter and latest tax transcript is needed. So I cannot answer if your specific embassy takes only into consideration the current amount you're making now, or also requires evidence from previous years. Hopefully someone else can provide you specific information.
