My husband (conditional LPR via marriage) received USCIS communication today. We filed a I-90 January 23, 2014 after his misplaced his green card (I know...). The letter states " USCIS records show that you were admitted or adjusted to a conditional LPR on October 29, 2013. You conditional LPR will expire on October 29, 2015. Since your conditional status is within 90 days of expiring, you are not eligible to receive a replacement of permanent residence. You must file Form I-751..."

Is it just me, or does that not make sense. It's still a whole year + 90 days from expiring. I think they may have just confused the dates. However, at the bottom of the notice it says "If you think this decision is based on an error of fact or an error of law you may file a motion to reopen with the correct fee." So if I want to clarify the mistake, I would need to do so and pay additional fee to reprocess?

Thoughts? I would appreciate any input! Thanks

Just to make sure. In part 2 of the application, did you select anything in section A? Double check to make sure since it's easy to overlook. Since your husband is a conditional LPR, you would select "1c" as the status and then "3a" under section B as the reason for the application.

Once you confirm that, you can call customer service to see what you can do next or make an infopass appointment. You should not have to pay a fee again since it's an error.

Agree with previous responses. Be sure to get it corrected, or at the very least, get appropriate documentation to the effect that you have attempted to correct their obvious error. There have been instances, where even though it was an USCIS error, the the burden to get it corrected falls on the immigrant.
