Hi I am a beneficiary under the F3-Philippines Category.

And according to my US citizen parent that filed my petition my priority date is June 2004.


In 2000 my FIlipino husband went to the US mainland and got a divorce.

He later married there and sometime in 2005 got divorced again from his marriage and he went back to the Philippines.


My question is, since under US law, I was divorced by my husband in 2000

Is it possible for me to convert from F3 to F1?

If so, how do I go about this?

Um, if your husband was still a Filipino and not a dual citizen, you might still be married in the Philippines. Divorce is recognized if initiated by a forigen spouse, not if the spouse is Filipino.

I see a long uphill battle for you if you want to persue this conversion, and/or get married in the future. A cenomar is going to be required at some point, and nso won't give you one saying you're single if you are legally married.
