Worker May Lose His Visa Because He Can't Flip a Pizza

well, there's more things wrong in his mileau (sp?) than just his lack of pizza flipping skills.

Its clear isn't it? had such a passion for Pizza, there was no room for love...

ALSO I read the comments on the Boston Herald. Besides Pizza ,he makes a killer Philly Cheesesteak. I think that he had a bad lawyer if he did not get that skill into play. If his cheesesteak skills are as good as some folks rave about, he should qualify for one of those "Persons of Extraordinary Ability" Visas

The content available on a site dedicated to bringing folks to America should not be promoting racial discord, euro-supremacy, discrimination based on religion , exclusion of groups from immigration based on where they were born, disenfranchisement of voters rights based on how they might vote.

I guess they were hanging their case on his artistic abilities, probably advertised the post as that being a requirement.

The EB-3 category has three subcategories: EB-3A, Professionals; EB-3B, Skilled Workers; and EB-3C, Other Workers . [5] For each, eligibility requirements include:

  • a labor certification
  • a permanent, full-time job offer
  • ability to demonstrate that the applicant will be performing work for which qualified workers are not available in the United States.

Separate requirements for each category are:

  • Skilled workers - must be able to demonstrate at least 2 years of job experience or training
  • Professionals - must possess a U.S. baccalaureate degree or foreign degree equivalent, and must demonstrate that a baccalaureate degree is the normal requirement for entry into the occupation. Education and experience may not be substituted for a baccalaureate degree.
  • Other workers - must be capable, at the time the petition is filed by the sponsoring employer, of performing unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature, for which qualified workers are not available in the United States.

Note that the requirements of an EB3 visa categorically states that NO qualified American citizen is available (or breathing!) who has similar skills...are we really to believe that there are NO American pizza flippers? You can thank immigration attorneys who avoid having their clients meet this requirement via a couple of underhanded techniques:

(1) the employer is supposed to advertise the job opening...the lawyer will submit ads in some podunk newspaper located 2000 miles away, like in Alaska, then claim that no one called to inquire and...

(b) if by chance a qualified American calls, the lawyer tells said applicant that the job pays $1.47 per hour with no benefits, and of course, the American says 'no thanks'...all documented (except the $1.47 part)...then the employer and the lawyer claim, 'gosh, we tried to hire an American, but gee whiz, no one expressed much interest and the one guy who did call declined our offer...'...yep...thanks to all those ethically challenged immigration attorneys (are there any other kind) who take personal pride in selling out American jobs to the lowest bidder...

How did we all miss this visa category. From now on If I see someone wanting to come to the US, I am definitely going to point them to this article and thread. we need to get some example forms here on VJ. Maybe start a new forum to accommodate the flood of people who are going to want to find out about it.

The Pizza Tossing Visa or ####### Visa for short.

Is there a yearly cap? we need more info.
