I-864EZ accepted by NVC but not by CO!!

Hello all,

My spouse had an interview yesterday.(August 12th). The CO said "your spouse income is not sufficient" and asked to submit a joint sponsor whereas the NVC reviewed my I-864EZ and accepted it without any issues. The income taxes for the last year I filed was just above poverty guidelines, about $800.00 above but my current year income is 4 times of that amount. It was all mentioned in the I-864EZ form and employment letter+pay stub.

Now, my question is, should I send the Embassy an email asking why the I-864EZ wasn't accepted? or what should be a proper procedure here?

Are you by chance self-employed?

If last year was above and currently you are above hmmm. Maybe they have bad eyes and you need to resubmit. I would contact the embassy and ask them if you can scan and resend and they review again they made mistake.

Are you by chance self-employed?

I think they didn't do their math and missed the $800 over hopefully they aren't so picky that you were too close I have seen that where people were with in hundreds and told to get a co-sponsor.

But contact them yes.

And you sure you looking at right guidelines (just checking)

A friend of mine had a situation like that. He was on unemployment for the most recent tax year when he filed and his salary for that year just squeaked in above poverty guidelines. NVC accepted his AOS. His salary for the current year was much higher, but the embassy (Moscow) still required a joint sponsor because he came so close to the limit on the last tax return. It's worth trying to get the embassy to reconsider but ultimately you may be stuck having to get the joint sponsor. Good luck!

Yes, I do not have any dependent. It's just me and my wife.

It is above 125% HHS poverty Guidelines ( for all other sponsor)

We waited so long and now this!! :(

I have emailed them to review and reconsideration. Let's see what they have to say.

Meanwhile, I already have managed my joint sponsor. Do you know if I(my wife) submit the new joint sponsor, how soon we can get the visa? Please note they didn't keep the passport.

Strange they didn't keep the passport =\ All I can offer is my anecdotal experience, hopefully it's normal for this type of situation. I stepped in to be a joint sponsor for my friend and the visa was issued the day after my documents were received at the embassy. Assuming the passport is submitted at the same time as the AOS documents I'd hope there wouldn't be an additional delay.

As an FYI to others who may be reading this, the NVC does not "accept" an I-864 or I-864EZ; they only check the forms form completeness and that the minimums are met. It's a CO that decides whether to accept an I-864 or require a joint sponsor.

My husband had his interview on the 10th... nvc didn't send them any of our documents because it was an expedite. the CO asked him to submit the AOS .. so he did but just a copy of them one I had emailed him.. without my signature! .... under AP .. then issued today! its really crazy how one embassy can be so picky and the other one not even care

USCIS, NVC, Embassy, all are part of the process but different entity and no one has jurisdiction over each other. Each entity is entrusted with certain responsibility and that's what they do. Does that mean mistakes don't happen? Of course; they are human too.

In this case embassy will make the final call based on what the CO deems as qualifying criteria. Getting into an argument with the CO on hypothetical or issue that is close to an issue is not going to help you. Now of course if it is a blatant mistake you can get back at them but not on judgmental issues. If you have the papers (W2 or papers) that shows your current income along with a employment letter, that would help. I am sure all you want is to get out of this jam like all others ASAP. Getting into an discussion with embassy and then going back and forth may not help you with a speedy process. Am I telling you to back out? Of course not, you will do what you think is best for you.

So far what I have understood from everyone's feedback is that, the CO refused to give the visa at that moment because my Income for 2013 was very close to the poverty guideline. However, I presented an Employment letter, last six months pay stubs earlier with the AOS which shows my income for the current year is 3 times the 125% poverty guidelines. Now that I have changed my job about a month ago, I sent a new AOS along with Employment letter, one pay stub to my wife, the income is now 4 times the Poverty guidelines. She showed it to the CO and CO looked at it and said for the year 2013, your spouse income is not acceptable, he won't be able to support you financially, we can not issue you a visa at this moment.

Thank you all for your wishes. Only VJ member can understand how it feels to stay apart from your loved ones.

So you need a joint sponsor. Each embassy has different requirements and it sounds like Bangladesh wants you to have the year before and current income over the poverty guidelines.
