Thank you for taking the time to kindly contribute to this forum! I have learned a lot from your responses.

I have a few questions about both the i-864 and the i-864a forms and wanted to ask your opinion.

BACKGROUND:
I was born in Argentina and am an American citizen. I am 21. In 2014, I married the woman of my dreams, who is also from Argentina -- and still lives there, as she waits for the application to go through. I am a full-time student finishing two degrees, do not make enough money to be a sole sponsor, and live with my parents. My stepfather, who is also an American citizen, will sponsor my petition.

QUESTION(s):
1. On form I-864 (link to the form: http://www.uscis.gov/sites/default/f...form/i-864.pdf), PART 1, I marked 1.a (I am the petitioner), and not 1.d (joint sponsor). Since my stepfather, whose house I live in, will fill out i-864a, does I mark 1.a OR 1.4?

2. PART 5, Question 1, I counted my wife as 1; Question 2, I counted myself as 1; Question 3 I did not count my wife as one because I did not want to count anyone twice; Question 3, I counted my stepfather as 1, since he will be combining household incomes with me. Question: Did I do this correctly? Did I count everyone the way they should be counted?

2. On Part 6, as my employment I put "student" and the college name and a current annual income of 0(zero). Then there is the paragraph, "Income you are using from any other person who was counted in your household size." Under that, on Person 1, I put my stepfather, his work, and his income. On question 10, I put his income. Question: Did I do this part correctly, also? Is there anything I should do differently?

3. On Part 6, Question 13, it asks if you have filed a Federal tax return for the three most recent tax years. I was a dependent until 2012 (on my stepfather's), and have just filed taxes on my own in 2013. My income was 0. So, I did not check the box on question 13. Should I include my 0 tax return from 2013 and write a cover letter explaining I was a full-time student?

4. On Part 6, Question 13.1a, I put 2013, and on 13.a.1., I put income 0. Is that right?

5. On Part 7, 5.a., I put my stepfather's name, and his income.

*** My stepfather is doing the i-864a

*** Is everything right? Should I make any changes to these forms? I am attaching my school transcripts to this application, as well as a photocopy of my passport and SS card. Should I include anything else?

then he doesn't need to file the i864A, he will file the i864

you aren't combining income, because you don't have any, combining income is to make enough to be over the poverty guideline

if you worked but didn't make enough, then you combine income to make more than enough, you have no income to combine, your income is $0

so you file an i864 as sponsor, your stepfather files an i864 as joint sponsor

by the way, I'm from Argentina too, from Cordoba

Since your income is 0 you have to file an I864 and your stepfather another I864 because you are not combining (0 income).

On your I864 click on 1.a

On your stepfather I864 click on 1.d and send proof of his green card(photocopy front and back) or A copy of his certificate of Naturalization or a copy of his U.S. passport biographic page.

Leave #13 blank, but attack a letter stating why you didn't file tax last year.

You can say something like this..... I was not required to file tax returns because I have never worked or didn't make enough according to the the IRS requirements and that you are a full time student. Don't forget to sign it.

I am doing the same thing, but my joint sponsor doesn't live with me.

How were you able to file taxes with no income? Sound interesting. From my understanding you are not combining anything since your income is $0. Let's wait what other have to say about this..

Hi, F&A!

I filled my taxes, despite the income of zero, because of graduate school requirements... I had to submit my own taxes, as independent, for financial aid.

I just finished preparing both i-864 forms, mine and my stepfathers, have attached proof of residency and have scanned our passports and driver's licenses.

Hope it will go through!

Im the immigrant, my wife is the petitioner and main sponsor and she doesn't make enough. Her father wants to help and we all live in the same household.

Does he need to fill a I-864, or just the I-864A?

09/29/2021 - Received receipt letter for I-130.

09/30/2021 - Filed I-129F through the mail.

10/12/2021 - Received receipt letter for I-129F.

12/17/2021 - AR Status change.

01/12/2022 - I-130 Approved.

01/13/2022 - I-129F Denied.

IF your wife has some income, then she would fill the I-864 AND her father would fill the I-864A to COMBINE both incomes as they live in the same household.

IF your wife has no income, then she fills the I-864 as the main petitioner AND her father fills the I-864 as the Join Sponsor to back her application.

I'm kinda of on the same boat;

Im the immigrant, my wife is the petitioner and main sponsor and she doesn't make enough. Her father wants to help and we all live in the same household.

Yes, she does have some income, but very little, ( she's a self employed writer)

So we're combining the incomes like you said with her filling the I-864 and him the I-864A.

One more thing tho, he filed his last taxes jointly since he was married, but he got divorced as of two weeks ago.

So do I need her to file the I-864A as well? Even tho she didn't even contributed to the income? She was a stay home wife. And she doesn't live in the house anymore either.

I'm calling the USCIS hotline tomorrow to ask about that since is something so complex.
