Living in Canada - Moving to US with children HELP

Timeline

I'm currently living in Canada with my 2 children that I have full custody of (with a clause in my divorce papers allowing me to relocate to the US with my kids). My issue is this:

The Georgia school year and the Canadian school year do not line up. My daughter is going into 10th grade and son going into 7th. I called the Georgia school admissions office and spoke with a foreign student advisor. She stated that I could enroll my kids in school as long as my fiancé gets an affidavit swearing that we live with him and he is financially responsible for us, as well as a current electricity bill to prove he has electricity hooked up. Also my custody papers.

I know that as Canadians we are allowed into the US for up to 6 months, at which time I'm hoping our K1 goes through. Now that I have given you all the details I'm looking for advice.....

Can I LEGALLY live with my fiancé and have my kids attend school?

When you enter on your k1 take your children's passports to USA school, that legally entitles them to attend school. I was on TN visa in Florida both my children attended school without issue. Save yourself the hassle and get all official school transcripts prior to registering them in school. So in summary you can not apply ahead of entering into USA and it's no problem the difference in timelines with kids in school. They compare each of the childs classes and decide the USA equivalency. Sorry one other thing, in regards to a utility bill....i will not be on my Fiancés to begin with, so the school said he could write a letter explaining we would now be living with him and the children.

Thanks for the reply nigel78. I called the USINS today and the woman got me nervous. She was saying that I need a K2 visa for the kids. I thought they could enter with me on the K1. I'm just so nervous about everything lining up.

Yes they will get a K2, when you start getting your papers filled out for your interview you fill out form for them also. They need a medical and your oldest if 16 will also need a police check.

You cannot enroll them in school until you all have your visas to move, sorry it sucks but it is the way it is.
