Im wondering a couple of things...

my american citizen husband is with me in Canada and we applied for his canadian PR 10 months ago, and it seems there is a hold on his medical because he was diagnosed with bipolar ten years ago. we cant really go on without him working here with me (could take up to 2 more years) so we're wondering a few things....we have work visas to new Zealand for one year, that we have one year to activate. we want to cancel the Canadian PR application and instead work on an American green card for me.

we are flexible, want to do things properly and want to be together as much as possible. my husband has not worked in the last year, but his family is very wealthy and owns businesses, and he has a trust fund.

we're wondering what our best options is...

should he return to us asap, set up bank accounts, get a job, and apartment, and then file after a few months and then we can go to new Zealand while its processing? or can he send in the I-130 without being there, from Canada or new Zealand? I guess im fuzzy on the time that he's allowed to be outside of the US while this is going on, and at what stages. I was denied entry to visit him a few years ago, so I wont bank on visiting while im actually trying to immigrate there. any feed back is welcome. thanks

oh also...we were married in june 2013, is it better to apply after 2 years of marriage and will it effect his side of things if he has bi polar?

He can file now while he is in Canada by sending to the Chicago lockbox. You can travel and live anywhere in the world while you wait.

His bi-polarness (sp) is of no issue at all no worries there.

Now one thing at interview he will have to show he has established or re-established domicile in US (all the things you mention, a place to live, bank accounts all that).

Look at the NVC Process Wiki under re-establishing domicile has some good tips and things to do.

Having his parents as the co-sponsor you will need so thats good they are on board.

You don't have to wait for your 2 year wedding anniversary. Tell him to file now if you are ready. It will probably be about 12 months from start to finish (as in interview and Visa in hand).

oh thank you so much. I think we will go to US in December for a few weeks and set everything up for him, and get his parents side of the paperwork done or ready....then travel in asia for a few months and then when we're in New Zealand we can apply...as we want to travel for another 2 years from today. its interesting in Canada you have to provide all of these things right away...which makes no sense really cuz a lot can happen in a year
