As a LPR (I got my GC through my ex-wife), will I be able to petition for my current wife under F2A.

(Is there a difference between a LPR through marriage and a regular LPR through family?) Am I eligible? ( I am applying Citizenship now but what if I failed and denied) Asking this as options.


My wife kept asking me why didn't I apply for her when I got married with her and she would have been a GC holder as in now. She wanted to visit her grandpa so much because he is 92 this year. She don't want to miss him as she had missed her granny. She passed away last year. She cannot leave United States due to fear of being denied renewing her visa.


I have a question from here, if she apply to renew her visa in China (F1) and she has a American Baby and me (LPR) will she be able to pass her interview without having fear of being rejected. Will the interviewer consider her case as extreme hardship for her getting together with her daughter and husband?

Your Post creates a lot of questions, you wife is a Chinese national? I am not an expert on this but the Priority date for F2A LPR spouses from China is 01MAY12. Do you already have a priority date or you are looking at at least a 2 year wait. However, this becomes current as soon as you become a citizen so you may end up waiting for your citizenship either way.

Depending on the circumstances of your previous marriage, I would think you might have an easier time once you are a citizen but it will really depend on the how well you can document your present marriage.

Yes my wife is from China and currently she is a F1 student with a valid status. She is currently living with me in United States and we do have a daughter now. ( she is born here)
