I've learned to not care about the AOS issue. I let people know that visit the USA with the intent to immigrate is illegal because it is. That's about as far as I care about the subject anymore. If people choose to do something one way or another, that's their problem not mine.

I hope the OP adjusts their status successfully and has a happy life.

It's not legal, yet it's legal, yet it's not... The more I read about it, the less I understand it. I think immigration cares more about people having bona fide relationships and clean backgrounds than how they entered the country, as long as they entered legally. I've even read accounts of lawyers and CBP officers telling people to "just come over on a tourist visa and get married, spare yourself the hardship". Not that I'm advising anyone to lie to any officials, that would be illegal. But entering the country, having life throw you a curve ball and adjusting your status is perfectly legal.

And most people who never have to deal with immigration have no clue how it works :P My in-laws seem to think that now I'm married I'm automatically an American citizen :S

Why would they attempt to understand something that is not legal, yet legal, yet it's not... I wouldn't! Ugh Now I have to tell my fiance he was right all along... well kind of right and not right all at once. lol!

All a K1 does is get you in the country legally with immigrant intent.

Not everybody has easy access to the US.

AoS from a K1 is essentially the same as for say a Visitor, there are some minor differences.

What I meant by my question is what kind of timeline are we looking at by doing this and AOS until I can work and travel? Is it about the same timeline as going through the regular spouse visa? Or more like when I'll be applying for it after I get married using k-1? that's one of the things I'm confused about.

I am going to assume you are in the US, if you are in Canada that would be against VJ TOC to suggest such a route. So ignore all the following if that is the case.

Regular spouse visa takes a year or so and you enter with an immigrant visa good to work.

Adjustment in country varies, but less than a year to get a GC, in the meantime you apply for AP and EAD that allows you to travel and work, this takes 60 to 90 days.

Work permit in best case scenario: 2-3 months. Green card in best case scenario: 3-4, perhaps 5 months. But in some cases it can take much much muuuuuch longer. You never know until it's actually being processed.

And yes, please do not misconstrue anything I say as advice to come over to the US on a nonimmigrant visa and adjust status :P There's still a real chance that you will have to face severe consequences if you try and work the system and get caught.

Ah thank you for clarifying that and I will ignore everything you have both said lol. We are good with the k-1 visa we will be together within a year and are enjoying our engagement and planning a wedding. I don't need to live on the edge and do something kind of ok but not ok.

Why are you quoting me as if I said that? I said it's an unfair system and am not suggesting anything out of spite. I'd like everyone to have to go through the same legal process. Not to have some people treated differently because they area allowed to visit without a visa. The point of the law is to be treated equal and not have such loopholes. Of course I'm resentful. Am I supposed to be happy I have to be apart from my wife and daughter? That makes absolutely no sense. It was bad enough having to console my wife 5000 miles away when she got very upset about being denied a visitor visa. But then to go through all of this stuff while knowing that if she was in the VWP we wouldn't have to do any of it make the resentment worse. And the icing on the cake is the fact that her country is a member of NATO and the EU and is a modernized, fairly thriving economy (by European standards) but its citizens still aren't allowed to travel here without an archaic visitor visa (one of only two EU countries). It's infuriating.

Well it's not being made easier. Far from it actually. First there was a USCIS backlog, then a partial NVC backlog (which is now full blown) and then we had the potential of another backlog with the State Department crash.

I'm at the end of my rope regarding this process and would appreciate it if you didn't lambaste me as some vindictive person who only wants other members to suffer. Because that's totally wrong.

US can't even fix the illegal immigration problem! Don't expect legal immigration to be fixed either.

I'm not arguing. I'm expressing discontent with how the system is. It's only normal to compare. I'm not expecting them to fix anything ever. It's broken and will be broken for a very very very long time.
