See below of what my attorney sent, yet we still received a RFE:

1. Form G-28, Notice of Entry of Appearance as Attorney;

2. Form I-129F, Petition for Alien Fiancé(e);

3. Check for $340 for filing fee;

4. Passport style photographs of Petitioner and Beneficiary;

5. Form G-325A, Biographic Information for Michael (Petitioner);

6. Form G-325A, Biographic Information for Yaoling (Beneficiary);

7. Letter of Intent for Michael (Petitioner);

8. Copy of Letter of Intent for Yaoling (Beneficiary);

9. Sworn Declaration of Michael (Petitioner);

10. Copy of Sworn Declaration of Yaoling (Beneficiary);

11. Copy of Birth Certificate for Michael (Petitioner);

12. Copy of Passport for Michael (Petitioner);

13. Certified Copy of Judgment of Divorce for Michael (Petitioner);

14. Copy of Judgment of Divorce for Yaoling (Beneficiary) with certificate of translation;

15. Copy of Proof of No Marriage Registration for Yaoling (Beneficiary) with certificate of translation;

16. Copy of initial chat interactions between Petitioner and Beneficiary;

17. Timeline of in-person interactions between Petitioner and Beneficiary;

After further research I can only think of one thing iy van be for my RFE....his birth certificate was not translated to English ="(

Wow!!!

I don't even recall sending most of these and you still got a RFE for what!!!

I know. My lawyer was so impressed with me how well I was prepare. She said none of her clients were as prepared as I was and that it should be a cake walk. I mostly hired her because the mailing addresses in China are ridiculous and I wanted to be sure I didn't miss something silly on the forms. Even though, RFE...

Meanwhile illegal immigrants are crossing our southern border as we speak...

On a positive note;

1. Someone actually worked on our petition today.

2. It was not denied.

3. It was just over 4 months and not as long as many others have waited.

So in a way, I feel very lucky. It feels so good to hear a noise out of all of that silence.

It is bitter sweet, a small victory I believe, so I bought a bottle of red wine and I will have a glass to celebrate tonight. :dancing:

looks like you were pretty organized. It is probably something silly. I have read comments that they (USCIS) loose things, so maybe they misplaced something out of your file. Don't worry too much, I am sure you are fine.

I don't recall birth certificate being a requirement to file I-129F. Only for Petitioner to show citizenship status.

I spoke with my lawyer, since it is confidential I won't quote her word for word, but her best guesses are:

1. On my legal documents some have the spelling Michael "ae" and some Micheal "ea". Though we qualified that I use both in the petition to nip that in the bud. In other words, we explained it in advance so that we would not get an RFE for something so silly.

2. Some inexperienced immigration officers send an RFE if the beneficiary did not sign the G-325 A. However it is against USCIS policy to do so. The signature is not required until the Visa interview.

3. Issuing a frivolous RFE as a delay tactic if they have to many cases pending. For example, people who know they sent their birth certificate however USCIS magically cannot find it.

Who knows what it is, just have to wait and see...

I don't recall birth certificate being a requirement to file I-129F. Only for Petitioner to show citizenship status.

The U.S. citizen (petitioner) has to provide either a birth certificate or copy of every page of the passport to prove citizenship. The beneficiary shows their's with the packet the send in to the embassy or at the interview. Edited by Meghan&Andrey

Husband? You're filing a K1 so I really hope you aren't married yet. And if you aren't, you might want to make it a habit of not calling each other by married nick names. They can deny you if they suspect you're already married. Just a word of advice.

I got the same to you, I dont know why I got RFE. It took 1 month for me to prepare our doc( 100 % mine and yours are same) . But just one thing I doubted is my finance changed working place last June. And one month he got unemployee money from govement. I thought this is reason.

2014/04/19: Sent I-129F Packet.

2014/04/21: USCIS received

2014/04/23: NOA1 received

2014/10/15 : got approval (NOA2)

2014/11/12: got case number through phone to NVC

2014/11/18 : case ready in VN.

2014/11/20: submit DS 160.

2014/11/21 : pay for visa fee.

2014/11/21: account active for booking.

2015/01/14 : INTERVIEW - APPROVED

we received our approval notice today. we got approved on 09/17 (Email). hard copy on 09/24, good luck for everyone still waiting.
