After a very long day the person interviewing us gave us my fiancee's passport and a letter stating your visa application is refused under INA section 221 g and further action is suspended. Further, based on indications that the petition contains inaccurate info we are returning it to CIS of USCIS for review and possible revocation.

What do we do? Thank you in advance.

Gather information why your fiance has been refused for visa. Is it about bona fide relationship from both of you or he had trouble with the US immigration before? After you found out what is the main problem then you can decided what is the best route for your fiance comes to the US. Many people here would suggest get married and filed for a spousal visa. But still not a guarantee an approval. If your problem is much bigger than you can handle, better consult to an experienced immigration lawyer.

Gather information why your fiance has been refused for visa. Is it about bona fide relationship from both of you or he had trouble with the US immigration before? After you found out what is the main problem then you can decided what is the best route for your fiance comes to the US. Many people here would suggest get married and filed for a spousal visa. But still not a guarantee an approval. If your problem is much bigger than you can handle, better consult to an experienced immigration lawyer.

How can I find out the main reason? Out of the all the questions they asked, the only one my fiancé tripped up on was the last time I came to see him. He said August, and then corrected himself and said it was February/March. Which even I couldn't remember, but she didn't ask me that. The only evidence they looked at were photos. Even thought I told them we had a ton more. Including messages from 2011 when we first started. But they did not want to see them.

Oh so they questioned about bona fide relationship from both of you because your fiance could not remember when the last time you visited him. I don't know your situation but I believe something beyond that made the CO thinks your relationship is not real.

Maybe it's just me, but this is a pretty important detail and would send red flags flying all over if it were me. Being in a long distance relationship it's pretty easy to remember exact dates that you last saw your SO especially if it's only once or twice a year. To stumble on a different of 6 or 7 months is very significant. Keep in mind these guys only have the information you provided and any background check info. If the answers given in the interview don't match what's in the submitted documentation it's a big problem.

Maybe it's just me, but this is a pretty important detail and would send red flags flying all over if it were me. Being in a long distance relationship it's pretty easy to remember exact dates that you last saw your SO especially if it's only once or twice a year. To stumble on a different of 6 or 7 months is very significant. Keep in mind these guys only have the information you provided and any background check info. If the answers given in the interview don't match what's in the submitted documentation it's a big problem.

Thank you. I was wondering if there were steps I needed to take, file a motion, wait for x before doing y, etc. Seems not though.

There was a member here after got refusal of K-1 visa and got married instead. The petition of K-1 visa had returned to USCIS and consider revoked. But oddly enough, USCIS reviewed again the petition. Unfortunately I could not find the post. You should make a call to USCIS. Got married is one of available options you can have now.

What is it that could be inaccurate on the I-129F petition? Maybe because you did not know when you last met in person? They are thinking you lied on the petition about the dates? Or could there be something else they believe could be inaccurate?

Sorry that happened to you :(

It will take some months until uscis take a desicion in your case, maybe they aporoved again but it is dificult but no imposible. But you have high posibility that they deny your petition.

You can take avance and be proactive, now that you are here if you have the time get marry and start the visa for spouse visa.

And noe be sure that you both answer very well.

you can start the process for spouse visa while they send you the letter about the fiance petition.

The petitioner would receive a letter from USCIS usually asking for additional information and/or proof of bona fide marriage. Unfortunately because DR is high in fraud a different answer raises a flag especially in K1 visas. Ultimately you will have to decide if to wait for the letter, provide the extra info and see if they will reopen your case, otherwise you wil have to go the CR1 route. Good luck!

Unfortunately for I-129F petitions they will just let them expire. You won't get a nice point by point letter from USCIS why you were denied and you need to address each point with evidence.

You say what to do. Well first what was wrong on the the application address that. get your dates right. CO's do alot of psychological questioning. They ask many times not to get the right answer but to see responses. Someone not knowing the last time their love visited screams of RED Flag and this is just for show.

Remember they don't know you. The evidence you presented wasn't enough to convince them otherwise and the questioning went bad.

I would have a sit down consult with a good DR attorney.

Hi everyone, I am back stateside and we decided we would try to fight this due to the time already invested and the time it is currently taking for the spouse visa. our decision may change as time goes on. we contacted our congressman and sentator. congressman said they will contact the embassy, senator said their is nothing they can do until the case is back in the US. I am obviously searching online as much as I can for anything that I can possibly do while I wait.

I found info regarding the Freedom of Information act, where I can ask for all correspondence/communications/records having to do with our petition, so that we may figure out WHY we were denied. Can anyone provide any experience with that?

I've read and re-read the letter over and over. What I keep re-reading is that the petition contains inaccurate information. I can't think of anything that is inaccurate in the petition. If they doubted the validity of our relationship, wouldn't the letter state that? I am just trying to make sense of all this. This denial is something I really was not expecting, and I am trying to understand it as much as I can. I am still so upset that he is not here with me and it isn't looking like he will be here any time soon. All of our hopes and dreams were brought to a screaching halt. I can't explain how miserable I felt at the airport watching all of these people get on a plane and my fiance had to stay behind, how painful it was to sit next to a woman on her first plane ride to the US, having imagined and dreamt about that being my fiance next to me. I hope and pray for a miracle or at least God to grant me the serenity to accept the things that are beyond my control. Devastated and heart broken don't begin to explain how I have felt every moment of every day since we were handed that letter.
