you'll have to wait for casefile intake at NVC , for any further determination.

after how many days the USCIS send the approved petition for NVC ? or if a case approved from USCIS how many days it takes to be at NVC ?

so when you say that I-130 and I-129F will, or are approved same time do you mean by that same exact day ? and if one petition is approved and USCIS said its sent to NVC how many days it take it to arrive at NVC first ? if I-130 was approved days after I-129F approval and saying it was sent to NVC is there a chance that the I-130 will still reach first before i-129F ?

Yes you will need the I-864 for the CR1. Either way you needed the 125% as per the I-864P however. Joint sponsor can be anyone, LPR or USC, who meets the povertypoverty guidelines and is domiciled in the USA.

I hate making spelling mistakes... Grrr. So much editing due to lack of proof reading. /bad NLR!

thewogans -

if the I-130 ain't approved yet - submitting a I-129F actually slows down the process. the I-130 is pulled out of it's place in the queue, and put together with the I-129F, at the end of the queue.

Now - once an I-130 petition is approved and sent on to NVC - the beneficiary is allowed to apply for the visa at the National Visa Center.

I don't understand what you've written in post #1 - is there some backstory we need to know about ?

it really depends on which service center it was, the USCIS time component for getting it out the door.

NVC is currently at 45 days from physical casefile receiving to opening it up and being ready to assign a consular casefile # [the start of that process].

add em together, and that's yer answer.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

if it was at TSC, and if they received first the I-129F and few days later or a week they received the I-130 are they still gonna close the I-129F since they received thei-130 or not because i-129f arrived first ?

Hi there,

Texas Service Center is currently working on January filers. You can expect approximately another 3 months for your NOA2.

i submitted both i-130 and i-129f to vermont service center, my i-129F was transferred to TSC and it was approved 3 days ago while my I-130 is still at vermont and under initial review, do you think it will still be approved and sent to nvc at same time ? how many days does it take TSC to send the approved petition to NVC ? btw i am K-3 not K-1

I have read here that K3's are now obsolete and rarely get approved. I have not seen one go through, you are probably better off asking this question on a K3 related forum http://www.visajourney.com/forums/forum/81-k-3-spouse-visa-process-procedures/ or http://www.visajourney.com/forums/forum/132-k-3-spousal-visa-case-filing-and-progress-reports/

Good luck!

I read that an approved I-129f automatically cancels an I-130 petition... Keep an eye out in the mail for a letter or notification regarding this. You cannot have 2 petitions approved at once.

it could get closed anywhere after USCIS -

if NVC sees the I-130 hit later and if the I-129F is still at NVC, NVC will close it.

if IV Unit sees the I-130 in the pipe at NVC, and the I-129F is at the IV unit, usually the IV Unit closes the I-129F.

Remember - the basis for an I-129F to go through the system, an unapproved I-130, dies when the I-130 is approved.

is there any particular reason you wish to chase a K-3 visa ? it's inferior, cannot participate in USA Society once here, unless file more paperwork.

yes i just want to be with my wife before its too late, where i live here militias are taking over week after week and clashing with army and taking over new areas, they are blocking roads and fighting army and things are getting worse, the country is like poured on gaz and a small spark with engage a civil war with foreign militias fighting such as al qaeda and ISIS, add to that the possibility that the consulate may close because of that, its like a battle with time, i just want to be with my wife, she is anxious all the time we already survived 2 car blasts when she was here, we really dont mind doing the paper work there rather than here and we dont mind paying the fee for adjustment of status
