I was reading the RFE MASTER LIST under K1 and some people got an RFE because they did not include their fiance's birth certificate. Did anyone from this forum receive a RFE for not including his/her birth certificate???? Did you include your fiance birth certificate????

When I was going through the USCIS level, i saw 2-3 people that this happened to- all of them had fiances that had traveled to the US. I had my finace send a copy just incase. They never asked for it.

27 March 2009 Check Cashed

30 March 2009 NOA received

8 April 2009 Biometric notice arrived by mail

24 April 2009 Biometrics scheduled

26 April 2009 Touched

...once again waiting

1 September 2009 (just over 5 months) Approved and card production ordered.

Apr 7, 07 - EAD card arrived!

May 10, 07 - Interview....APPROVED!!!

May 23, 07 - GC in hand

Feb 10, 09 - I-751 sent to CSC

Feb 12, 09 - NOA1

Apr 20, 09 - Approved!

Jun 12, 09 - Card Production Ordered

Jun 19, 09 - 10 year GC Received

We did not include it, and we did not receive an RFE. We filed through California via Texas.

I'm the USC.

11/05/2007........Conditional permanent residency effective date.

01/10/2008........Two-year green card in hand.

08/08/2009........Our son was born <3

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

03/01/2011........Separated.

11/05/2012........Eligible for Naturalization.

I got an RFE for that when I filed our K-1. I guess I didn't read closely enough and I didn't include it even though I had it. They also asked me for proof of citizenship, which I had already provided, so I had to send that once again.

I got an RFE for that when I filed our K-1. I guess I didn't read closely enough and I didn't include it even though I had it. They also asked me for proof of citizenship, which I had already provided, so I had to send that once again.

It is something that they use to ask for right? The current forms do ask for it. BUT from what I read USCIS adjudicators can ask for anything even if its not on the original list.

I don't see where it's required in the I129F instructions. I do see that the USC is required to submit his/her birth certificate or all pages of his/her passport to prove citizenship but I don't see where the beneficiary's birth certificate is required. Does someone have a reference for this? :unsure:

I got a RFE for it... two weeks after it was received our case was approved. Guess they just wanted to see it <_<

6/23/06- Engagement Party in Egypt

7/19/06- NOA1

10/02/06- RFE email

10/07/06- RFE received (birth certificate)

10/11/06- CSC received RFE

10/24/06- APPROVED!

10/28/06- NOA2 in mail

11/08/06- Left NVC

11/09/06- Petition arrived at Cairo Embassy

11/23/06 - Packet 3 received!!!

12/05/06- Sent in Packet 3

12/14/06- Went to Egypt

1/17/07- Came back :(

1/18/07- Packet 4!

2/1/07- Interview ! ! !

07/17/07- Finally in Hand

07/22/07 - Arrived in Dallas :)

I didn't really see where they did ask for it and I was very careful but I could have missed something. It delayed us for about 6 weeks then we got the approval.

I just looked at the instructions again and still can't find where it is required. I'm wondering if it's a K-1 thing? I'm not seeing any of the K-3 people saying they got an RFE for it. Then again who knows since it's the same form for each. This is so confusing. I guess I could have him fax me his birth certificate and send it in just to be on the safe side. better safe than sorry.

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

For the I129 they did not ask for it. But if you read the RFE Master List under K1 you will find that some people received a RFE for not sending it in.
