Hi.

I'm filling out the I864 with my wife and the Example Form is very different than the form we downloaded from USCIS.

I came to the US on a K1 Visa and I'm now about to apply for AOS.

Is the example I864 Form we have here on the VJ Website old?

Yes it is an older version, but still can be used as a guide.

Also if your income is more that the 125% of the poverty line, and you dont need to rely on assetts or a joint sponsor consider using I-864EZ less financial evidence needed.

I-864EZ

K-1 holders can use this form (I-864EZ) when adjusting status in the states, they use I-134 when interviewing for the visa at the consulate.

one more question, about question 19.

if you are providing evidence for the most recent tax year only, is it necessary to fill in the amount earned for 2nd and 3rd most recent years? Or is this only if one intends to use those years as extra proof?

the reason is that in the 2nd and 3rd years, my husband only worked part time and earned way under the minimum,

thankyou

That is the same question I have.

Can anyone help us with this?

:)

Also, is that ok if the current annual sallary is more than the last year's tax income?

I'll be proving that with a letter of employment.

The requirement is that you list your income for the past 3 years in the spaces provided, it is optional that you provide tax records to support those amounts.

Of course it's acceptable that your income is higher in this year than in past years................people do advance and improve.

Consider this..............tax records show a glimpse into the past and employment letters /pay stubs indicate a view of your current/future position.

Current income is what will hold the most evidential weight.
