Timeline

Hi all,

we are finally on the AOS process now, but we have a question about I-864 form. Since my husband and I both don't have a job yet, but he has some asset on stock. I am wondering if this will be a problem when we apply for the AOS? I know there are sayings about meeting the minimum income, but can someone tell us how much exactly do we need if we both dont have a job yet? Thanks a lot for your help!!!

You can read the latest poverty guidelines here: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

In short, he would need to demonstrate an income of either $19,662 for a family of two (i.e. you and him) or $58,986 in assets if he wished to qualify through assets alone.

If you cannot meet either requirement then you would need to obtain a joint sponsor.
