Timeline

Ok my wife got here 5 June, today we got married. But I got a few questions. If I'm right the next step is do the:

1) "Adjustment of Status"

2) "Employment Authorization Document" (so she can work)

3) And an "Advance Parole" ?

Is That right?

- how much will that cost?,

- and I see I have to do another Affidavit of support but I haven't worked much in the last few years because I was in Vietnam for over a year and since I've been back work has been slow. Been living off savings but now that's getting low too. We are thinking about moving to where there is more work. I never even filed income tax last year.

Will I need someone else to do the Affidavit Of support too, my sister will do one?

If I move who do I need to tell?

Any help will be appreciated.

For the questions 1,2, and 3 the answer is yes. When you filed I-485 along with I-131 (advance of parole) and I-765 (work of authorization) you only pay $1.070 since the fee of I-131 and I-765 is waived. This is the guide.

Ok Thanks I guess another way of asking the other question about my not working is can you have a co sponsor for this portion?

yes, you can. both you (even if your income is 0) and the co sponsor need to submit a new affidavit of support, the I-864. you need to also submit the supporting documentation for the I-864, which includes the previous year's tax returns and proof of current income. if you did not file a tax return last year, you should include a letter/note explaining why (e.g. you were not legally required to file because you made below x amount of money) you did not file.

You will need to file the I-485 to adjust her status, I-131 (International Travel permit), I-765 (Work permit), G-325A (biographical info) for each of you, and I-864 for the US Citizen and joint sponsor.

With the affidavit of support you must include the 2013 Tax Return, W2's, recent pay stubs, and employment letter. If you did not file taxes

you must sign and date a tax return affidavit.

Also include a copy of the I-130 approval notice

You must include passport pictures, check for immigration, copies of your birth certificates, marriage certificate, her K1 Visa I.D. page, any divorce decrees if either of you were divorced, & I-94 arrival/departure record to prove she entered the country legally.

Any docs not in English must be translated

Someone adjusting from a K-1 visa does not file an I-130.

1. Yes that is what I said is it not? The most recent tax return would be 2013

If you do not have your 2013 tax return then you would need to obtain the IRS Transcript

Never send originals

1. Does not matter if you have your return or not. You can still get a free |IRS transcript and send it. That way you do not have to worry about whether or not you sent the complete return.

2. There is no 'tax return affidavit'. You simply need to provide a statement explaining why you did not have to legally file taxes any of the last 3 years that you did not file. No notarization needed.

4. No need to include things that are not required/not asked for in the I-485 instructions.
