Hello,

I am a Green Card Holder and am planing to file I-130 for my mother, but there is below issue

My Birth Certificate says her name as PATEL NIRMALABEN N

Her Passport / BC and School leaving certificate says PATEL NIRMALABAHEN N.

In Gujarat both are used interchangebly.

So along with I-130 when I send my Birth Certificate, officially my Mother name is NIRMALABEN. But that will contradict the passport copy which I will send along.

Please guide what to do.

To petition for your parents (mother or father) to live in the United States as green card holders, you must be a U.S. citizen and at least 21 years old. Green card holders (permanent residents) may not petition to bring parents to live permanently in the United States.

hi

ditto, you cannot petition for your mother until you are a USC. That will give her time to correct one of the two, or she corrects her passport or she corrects her birth certificate, whichever was incorrectly done.

Best option would be to get your birth certificate corrected, to match her passport and other documents. That way, she will not have to change any of her old documents. IF this is not an option, then you will have to take the path of having her documents match the name that is mentioned in your birth certificate.
Unless the names match, you will either get the process delayed or rejected. Indian affidavits confirming both names are of the same person are known not to impress immigration officers.

What is your mother's name mentioned as, in your passport?

Yes I agree with the above. You HAVE to make sure her name on your BC matches what her name is.

My uncle was petitioned by my grandma and his BC has her name listed as middle name, first name, last name. I advised them that was going to bring some issues. I also know a person who's mom got rejected because the spelling of her name was different on all docs, especially on her BC.

I realize that back then people didn't really care to correct this kind of stuff, and it's come to bite a lot people with this new digital age and what not.

You can file for your mother the same day you take your oath ceremony and receive your naturalization cert. so use this time to get your BC fixed. Good luck!

This does not constitute legal advice.

hello, I would like to ask if I might get denied because my mother's name is Anna Lisa Vino but her name in my BC is Anna Liza. Please answer, thank you.

In this case it's a one letter difference, so I doubt it. If you are able to, I would try to get your BC or her BC fixed, whichever one is incorrect to avoid any potential issues.
