I-130 for stepchild, frankfurt , information needed

Hi,

I just got my visa approved , and my husband will file a petition for my son, his step son.

I assume that the permission for my son to travel and move to the USA needs to be shown at some point, when is this, with the paperwork that has to be sent with the DS-260 confirmation page, at the interview?

Anybody out there with a similar experience?

( my son is 15, turning 16 in November, we are waiting for a court to decide as his father wants a judge to make this decision, long story...................)

I'm willing to take the risk of getting the I-130 done first to cut on some time here, so he may be able to travel with us if the court ruling is in our favor.

the question is, at what time in the process do I need to provide paperwork that my son has permission to move to the states, either approval from his father, or per court order.

Mark88, thank you for the answer, when you say at the consulate stage, do you mean when sending in the paperwork after submitting DS 260 or with the interview, if you know..............

Depends if you do DCF or file over NVC. How are you filing?

we are doing DCF

You submit to Frankfurt, and wait until IV unit asks for the required document. This can bee days after you file, or on the day of the visa interview. Will depend on the officer who handles your case. Did you try calling/email them and ask this question to them?

Thank you for your help, I have the I-130 ready to send out, as soon as we get the approval we will send it out. By the time we have the court paper the petition may be approved and we can do the rest.
