Any child of yours that is under 18 is wholly dependent no matter who they live with. Any child over 18 is partially dependent. Any child that isn't yours via birth or marriage is partly dependent ( like a siblings child living with you )

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What about my son who is 20 years old and has his own apartment and works 40 hours a week- why would he be a dependant? He doesnt depend on me for anything hes an adult. I dont claim him or my 9 year old son on my taxes either. So my 9 year old is wholly dependant even if my ex has full custody of him and claims him on her taxes?

That is incorrect. If you have a 22 year old daughter and she has 2 children and married and her and her husband works full or part time and file jointly on their taxes are not your dependent. If you do not claim any children on your taxes they are not your dependent.

Now if you do claim any child on your taxes then they are your dependent regardless where they live.

consulate received petition July 8 2014

consulate received hard copy of petition(CEAC website update) July 15 2014

passed medical (took one day fiancee got there at 4:00am finished at 4:30pm) July 22 2014

CFO completed certificate issued (fiancee said people were very nice process very easy) July 30th 2014!!

Interview date scheduled for September 10th 2014!!

Interview approved!!!

Visa issued!! CEAC website September 16 2014!!

Visa received on September 18 2014 yeah!!!

POE September 21 2014!!! Yeeees!!! What a journey!!!!

Wedding day!! October 16 2014!!

Now if you do claim any child on your taxes then they are your dependent regardless where they live.

Wrong any minor children are dependent on you even if you do not claim them on taxes. If the other parent dies they are your problem and you are legally required to support them until adulthood even if they reside with their other parent. Any child over 18 still in your house ( or going to school ) is partially dependent on the theory legally you could stop paying to support them with no legal issues.

I agree an adult children residing in your home and going to school is a dependent. minor children that do not live with you and that you do not file on your taxes is a complicated issue. It really depends on the situation. Rapid Visa who does k1 and spousal visas as well as a whole bunch of other visas. Has a very high success rate when it comes to preparing documentation for their visas application advised if you don't file taxes for a minor child and that child do not live with you, then it's best not to add them to the I-134 form.

Well since they have so many clients getting their visas approved with no issues with the I-134 form and I mean many many clients, I am going to listen to them since I paid them my money and talked to so many of their clients.

I will keep you posted when our interview is completed.

But it's been a pleasure talking to you and I am always willing to hear other people views. I think that op should add his children if he had doubts or consult someone who has complete knowledge on this matter as you and I have!!!

Like I said everyone situation is unique and different.
