hello, my self rocky.

i am from india.

i went to usa on b1/b2 visa when i was minor age. i have overstay in usa about 5 years and then i came back to india voluntary.... no deportation...

i know i have 10 years ban.... my 10 year ban will be over in next 1 year...

i would like to go to usa again.....

what should i do if i want to go back to usa again?

plz give me a advise since you all have experiance with good knowledge of this...

should i apply student visa or tourist visa? my 10 year bann will be over in 1 year now.....

thanks a lot to alll who reply me or who doesnt....

Your ten year bar will expire ten years to the day from when you departed the US. For example: if you left the US on 1st January 2010 then your bar would expire on 1st January 2020.

You will have a very uphill battle obtaining a visa, as you have already overstayed a visa once.

Bear in mind that minors only accrue overstay once they turn 18.

yes i got it but do i have any chance of getting torist visa after my ban over.....

have u seen any people getting visa after their ban is over and overstaye issue?

Hi - I also had a 10 year ban for overstaying on a tourist visa for 6 years (i got to the US when I was 17). It has been 13 years and my current employer has asked that I attend business meetings in the US. I recently applied for a B1 visa and got approved. So there is hope... I believe what is important is that you are able to establish strong ties in your home country and prove that you will not commit the same mistake of overstaying. My interview was long and I got asked alot of questions but I believe being honest and forthright on your application and during the interview is essential.

The harm has already been done so there's no beating around the bush. Your chances are slim but you can be approve if you really have a strong reason to go to U.S. Maybe sponsorship from a company or a relative or spouse file for you.

How will a relative or spouse file for a tourist visa?

And the COs don't particularly care about reasons WHY someone wants to visit the US, they care about what reasons they have to leave.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
