Hi my name is Vinnie (or vince) I am from canada I have been here in the U.S since 2009 on two different f1 visas one for community college and one for a 4 year that I transferred on a scholarship, I did my junior year at the school, however my senior year which was supposed to be this past year my head coach got fired new coach came in and cut me from the team so being depressed I left school and dropped all my classes. A few months later (around christmas time last year) I met the woman of my dreams a few days before I was to go back to Canada, I went back to canada for a month and came back as a student under f1, I had trouble at the border because my school did not sign off for me to leave, but they let me in and wrote a note on my civis, anyways I came back thinking my scholarship was still good because the school sent me a check in the mail so I had planned on taking online classes while staying in san diego (the school i had a scholarship to was in Hawaii) however few weeks after they emailed me saying that because I dropped out of my classes the prior semester my scholarship was no longer good and i had to return the check long story short I appealed some fees that they charged me and got denied and on top of that my visa got terminated as of late march (I'm still below 181 days out of status) and they wrote a note on my civis as well and told me I would have trouble getting back into the country. Anyways I stayed here we developed a strong bond and relationship and got married about 3 weeks ago we live together I'm under the lease but here are my concerns.



1. Is the fact that I dropped out of school and violated my visa going to be a problem?


2. The fact that I entered the country on my f-1 even though i technically wasn't supposed to is that going to hurt my chances at getting a green card?


3. Can someone tell me exactly which forms I have to submit and how much it's going to cost? I heard the whole process should be around 1500$


4.I might potentially have another scholarship to play somewhere else out of state if it works out I'm going to have to move will that hurt our chances? and also can I even go to school since I don't have a SSN (school starts within a month)


5.I have debts with my old school and also some medical institutions and medical issuance like blue shield, when I do get my SSN will the collection agency still be able to ruin my credit? May i remind you guys I hyphenated my name with hers so my name has changed.

You think because you hypenated your name you can be free of your school and medical debts? Of course they can ruin your credit, and deservedly so. You owe.

If for some reason you can't do the AOS or don't qualify, you can always do the CR1 and apply from Canada.

You asked. She answered. You still owe for your debts. Hyphenating your name does not make you able to hide from or take away the debt you rightfully owe.

A collection agency will be able to find you by doing some basic research. Even if you hyphenated your name, does not mean you escaped your debt. Nice try LOL. If you do not pay, yes it will RUIN your credit score in the United States of MURICAAAAAA

dude, the people who do background checks for a living can still hunt you down even if you hyphenated your name. fosho. and doing the AOS from the F1 will not reduce your chances of successfully adjusting status if you can demonstrate that you didn't have immigration intent when you applied for the F1 visa, and more importantly that the marriage was bona fide.

Hi,

1. No.

2. No.

3. Look at the Guides.

4. Based on what status will you enroll in school? You're F1 is no good. Being married to a USC and filing to adjust does not give you legal status to attend university.

5. The collection agency did not ruin your credit as you stated. You ruined your credit. Hyphenating your name does not change anything; you can't hide from your debts.

Actually being out of status doesn't stop anyone from attending a college. It depends on the policy of the college if they accept students with other than legal status.

CUNY, for example, is a public college system here in NYC and they accept undocumented people, so they should accept someone with a pending AOS.

Also if your college does accept you, you may have to pay out of state resident tuition rates. Again here in CUNY, they allow you qualify for resident rates if you have valid proof of address regardless of immigration status.

You definitely wouldn't qualify for any financial aid though, I'm not sure about scholarships.

So you have to find out with the college you want to attend what the policy is for undocumented or otherwise not "legal" status students.

1. Yes it can be a problem. You HAVE TO maintain full time student which is 12 credit hours. You can reduce credit if some reason but you still have to maintain at least 8 credit hours. Unless you get an accident and cannot make through semester.

2. Yes it can be a problem but you never know. It's hard to tell it's going to be a major problem or not it all depends on circumstance.

I-485 ($1070=985 fee +85 Biometric fee)

I-693 (Depends on Doctor)

I-864 (No cost)

I-131 (Optional no cost)

I-765 (Optional no cost)

4. You don't need to have SSN to go to school. Also you can still apply for AOS even you move to other state. However if you move during the process, USCIS has to transfer your case to another office. It potentially makes your case taking longer to finish it.

5. I am not sure about this you can contact to your school's financial office to find out.

sigh...wake up people. Noone runs a credit check on your name it is yoursocial secuirty number that is linked no matter what name you use. My advice : GET A LAWYER your case I am sure would be red flagged. whether it is true or not, i do not care, but you would certainly be scrutinized very closely.

That's what I thought and it's the reason why I asked, to my knowledge they can't get you without your social because there is no actual proof that it was you if you follow, but either way I can pay my debts they aren't that much, I just wanted to know if it would affect my credit.
