Hey everyone,

I have some questions regarding the financial support. My boyfriend doesn't have an income at this very moment. He has some savings in his bank account but not enough to prove we can support ourselves. One of my question is, can we have a joint sponsor if he has no income?

And another question, if he finds a job next month could I use only one pay stub or 2 to go to the interview? Or you need a certain number of months (6 or more) before you can do that?

Any answer is kindly appreciated! Thank you very much!

My fiancè did not have an income and we had a co-sponsor (my future mil) which was accepted. I'm not sure of 1 or 2 paystubs will be enough because he will not have been employed for very long. How long has he been unemployed?

He has been working (more like helping) his parents but only little jobs. Anyway, he's 26 so I don't think anyone expected him to have been hired for too long until now. He will probably get a job asap but I'm not sure how it will work for the AOS. Is there a requirement of being hired for a certain period of time?

Do his parents have a business? Was he working for them prior? How long has he technically been unemployed?

I'm also 26 and I've had my career for 4 years So not sure what you meant by his age. There's no minimum requirement of being employed to be a sponsor but they might want to see that he can support you long term and him being unemployed for a long time will work against him without a. Co-sponsor.

Can one of his parents be a co-sponsor?

His parents do not want to help, though they could be because they have the income we need. Anyway, this is not an option anymore. And I'm 25 and have been working for more than 3 years but that's not the point. Mentioning his age was just to emphasize that he could be considered a student who recently graduated and it shouldn't be a problem that he was unemployed for such a long time. He was never on welfare or anything like that. I think we can find a co-sponsor for my interview but he has no income now so I was thinking that we cannot have a co-sponsor cause co-sponsor means you have something, but not enough. Well, in this case we have no income. And for the AOS, if we need a co-sponsor (which I hope we won't) does he/she has to be an American citizen?

Sorry to hear his parents don't want to help. Unfortunately they will definitely go off his actual financial situation and because he is not a student they will see him as what he is - an adult long term unemployed. At the AOS stage the joint-sponsor will need to meet 125% of the poverty guideline for their household size (joint sponsor + beneficiary + any dependants they list in their tax returns)

And they will need to be a U.S. citizen and you'll need to send their birth certificate or naturalisation certificate with your AOS to prove this.

I would also take a look at--or start--threads on the Romanian consulate you will visit. The K1 affidavit of support for some (like the London consulate my husband, then fiance, visited) is more of a throw-away than at other consulates (Philippines take it very seriously, for instance).

You can certainly include the pay stubs from thew new job--but the BEST thing you can include is a letter from your fiance's new employer stating that he is employed in steady work and what his expected yearly salary will be. That DOES count toward considering finances. Sadly, being a student or having student status, as far as I've read or experienced, doesn't get you anywhere or exempt in any fashion. You'll still need to hit those requirements.

It is sad that his parents won't help, especially because there really is little risk involved in signing those papers--very little actual legal responsibility. The number of cases where legal action is actually taken by the gov't against these co-signers or even the petitioner....well, none of us on VJ have really heard of them--urban myth!

Anyway, I would see if he could get a letter from his employer that shows he will be employed steadily and that his income will contribute or even make the 125% line. But you could also ask him to revisit the forms with his parents and give them a more thorough understanding of the requirements of the forms....or if he has siblings, grandparents, etc., who could help out....

If you have enough savings yourself that can be considered, as well, though it would need to be considerable to make up for several thousand U$D in payment gap.... Good luck!!!
