I'm not sure if this is the appropriate place to post this question.

My fiancee from Philippines has had her visa approved but is worried that she "won't be able to leave the house and can be subject to prison" after we marry until she gets her green card which is a lengthy process but I've told her that she will be able to go anywhere in America, just can't leave America until she gets her green card.

Am I correct or is there anything we should be aware of?

Thanks in advance for your help

From her POE arrival date, she can go anywhere in the U.S. she has no restrictions. She can leave the house, there is nothing about leaving your house to be subjected to prison, that is ridiculous.

Also please fill in your timeline?

Thanks :)

To add on that, you can apply for advanced parole when you file for Adjustment of Status which takes about 60-90 days from the date you receive the NOA from USCIS to receive the card. Once you receive that card she is authorized for emergency travels back home if something happens.

Great advice!

Thanks so much to both of you for answering my question and for the additional tip about advanced parole!. :)

I'll try to fill in the timeline this weekend. :)

One last thing to remember, is when its available (approx 10 days after arrival at POE) go to the following website: https://i94.cbp.dhs.gov/I94/request.html

This printout should be carried up until you file for AOS. Once you receive your NOA, that is what she will have to carry around. This is just for precautionary measures in case you live by an international border and get stopped by an immigration office at some sort of check point.

As said when you file for AoS (GC) also file for EAD and AP, this will enable her to work and travel outside the US and return. It's not just for emergencies either, I used mine 4 times whilst waiting for GC for business travel.

Read the guides on here, very useful. Read the instructions for each of the 3 forms you will need to submit (485 for GC, 131 for AP and 765 for EAD) and follow them.

if you file all 3 together there are no additional fees for EAD and AP it's all included in your AoS fee of $1070 (incl bio fee)

I appreciate all the great advice and tips! Very helpful! And I wanted to update you all on what's happening (let me know if I should post this in a new thread? Also I still haven't updated my itinerary because we've been so busy with plans, moving, etc but plan to as soon as I can)

My fiancee has her K1 visa and we're looking at flights but I found out from the airlines she has to buy her own flight at Cebu Airport then I have to immediately buy a seat on the same flight back because I want to fly there to stay with her family for a week then fly her back with me to the US so she won't be traveling alone.

This seems tricky, have any of you had any experiences doing this? Any advice for me? I'm hoping for a flight for one from Las Vegas to Cebu and and for two coming back to Las Vegas (not going through Manila due to the risk of typhoons)

Thanks so much,

Bruce

I want to add that the flight agent I talked to recommended we talk to the same airline at the same time as she buys ticket at the airport so I can give her flight number to the agent I'm talking to to set up a round trip that would put me on the same flight coming back as hers which seems like a pretty good idea.
