confused american wanting to marry a canadian

Timeline

We have dated for over 5 years and are finally ready to say yes. with all the new laws I really do not know where to start. we want to get married in vegas but then he would move to the states with me and we both do need to work as we are an older middle income couple. i would like to have all forms with me when we go for the vegas wedding. what forms do i need to fill to keep him in the usa with me?

You cannot visit the USA with the purpose of staying without a visa. The CBP would deny you entry and to lie is to risk being banned for life from the USA.

You have 2 options:

K1 visa - faster to visa, more expensive, requires period of time (90 days approx) before you can travel outside the USA or work, live together after marriage, must marry within 90 days of entering the USA

CR1 visa - must be married first, cheaper (unless you live close to Vancouver), can work and travel outside the USA right away, wait to live together after marriage (about a year or so), faster to green card (generally)

AS NLR responded - unfortunately there is not a way for him to come to the states to get married and then stay

My husband and I chose the route of getting married first then apply for the visa. We went to Vegas to get married - then he went back to Canada and I went back to NYC. We just kept up with our regular lives/routines/work and also visited each other while we waited for the CR1 visa to be processed

The CR1 process is long, but it is really good that my husband could work as soon as he crossed the border/moved here. Everyone's situation is different, so definately read up on the 2 different options and figure out what works best for your situation.

The K1, if you want him to be able to move as soon as possible. The CR1 if you are willing to wait a bit longer, but he'll be an LPR when he enters.

It's up to you to weigh the pros and cons of each with the fees, wait times, paperwork, etc.
