Hi all,

I need help, I am so happy that finally we got our NOA2 but then I realize a big potential problem. We have already planned our wedding on 10/3 this year and my fiance just got the NOA2 last monday (7/28), it seems like most likely the interview will be scheduled around mid-Sep, after they approve it, they will take his passport for visa printing, and it might take up to 2 weeks or more for him to receive the passport which means he might not have his passport with him in Oct.

But he NEEDS the passport to travel to the US before Oct, the wedding has been planned more than half year ago and most money has been paid, his friends and fmailys have also bought the tickets and booked hotel, we cannot pospone the wedding. I am really worried now, any idea how we should manage this situation?

Hate to say it but you should never book any arrangements, flights, weddings, etc until you have the VISA in-hand. If you do not postpone the wedding he might not be here to participate. Now that would be a waste, would it not? Good luck.

Travel for what ? Wedding ? It will invalidate whole K-1 if you postpone the interview and get married... Your only choice at this point (if you want to keep K-1 alive) is pray for the process to go quicker so you make it in time, or try to move the wedding...

I am sure you'll hear from other about scheduling wedding without having a visa, so I won't say anything...

The reason we plan it because he does not need a fiance visa to travel to the US, our planning is even we do not have the fiance visa on hand, he will just travel here as a tourist and we can still have the wedding (its just a celebration, no legal document invloved), then he goes back to his country after the wedding

sorry i didn't make it clear, its just celebration wedding, no legal document invloved, of course we will do the legal marriage document after we have the finance visa

so by law, we are still not married but we are having the wedding party before

You are calling this a wedding. You cannot get married and have him leave and come back for the "real wedding" on a K-1.

Quit calling it a "wedding party". Never use the term wedding, if it is not a wedding. Why not wait till he gets here on the K-1?

Replying to your question "Can we request to postpone the interview date?"

You are very much in control of your interview date in London. Three things must be in place to even be eligible:

1) you submit DS-160

2) your medical results are received by the embassy

3) you submit the Readiness for Interview form

Hold off on any of the three and you won't be assigned an interview. If you haven't interviewed by Nov 28 (petition approval expiration) then London requests a new letter of intent from the American to revalidate it. Simple enough to take that to your interview.

Replying to your question "Can we request to postpone the interview date?"

You are very much in control of your interview date in London. Three things must be in place to even be eligible:

1) you submit DS-160

2) your medical results are received by the embassy

3) you submit the Readiness for Interview form

Hold off on any of the three and you won't be assigned an interview. If you haven't interviewed by Nov 28 (petition approval expiration) then London requests a new letter of intent from the American to revalidate it. Simple enough to take that to your interview.

Do you think it is possible to have the Visa printed before 10/1, does it take more than 2 weeks to receive the visa from the interview date? or we should do it later just to be safe

I don't keep up with timelines, so don't know how long it will take you to get from the Service Center to NVC. Mine was in London days after NOA2, but I see people commenting on it taking a month now. I just don't study that part. What do you know about that part?

An overall average would be interview maybe 6 weeks after everything is in and visa a week later. But you can't count on being average. Stuff happens like computer problems. Even if your file had already sailed through NVC to the embassy and your medical appointment was this week (results delivered early next week), I think it would be shaky to think he might have a visa in time. My gut tells me it is a very long shot.

Call the NVC to find out when they get the file and assign your LND number. Then work out your odds from there. I am assuming you have already done shots and police report. I suppose you could try to push through and if it didn't work out, then send the form asking for a new date. Right now it depends on how soon it gets to NVC and a case number assigned.

I saw few London beneficiaries are able to receive their Visa in hand about one and a half month after receiving the NOA2. But true, I can't count on the average and the histrocial statistic and i haven't even recevied the hard copy of the NOA2 yet, called NVC today and our file has not been delivered.

We already have the police report issued in early march, he is working on the shots. From your other post, you mentioned that when the beneficiary complete the form online, it asks if you have your wedding date planned, sometimes they will try to schedule the interview to accommodate it, but it is not guaranteed. I will see when they assign me the LND number to see which way is better.

The website that matters is London Embassy. Read it. Study it. You don't want to miss a detail. It says--

Police Certificates for the United Kingdom: A visa applicant who has resided in the United Kingdom for 6 months or more since the age of 16, is required to obtain a police certificate from the ACPO Criminal Records Office (ACRO). Further information is available from their website at www.acro.police.uk. This police certificate will serve to advise the U.S. Embassy, London whether or not any criminal conviction is held against him/her. The police certificate will be sent to the applicant's address provided at the time of application. Please note that the Immigrant Visa Unit considers the police certificate valid for 12 months from the date of issuance, not six months as stated on the certificate.

There are maybe, if you get lucky, shortcuts, but it is all depending on USCIS to NVC before you can start your engines. He needs stuff in place like yesterday so when you get the word from NVC, he can book that medical for the next appointment and zap off the DS-160. Sorry but I really don't think you have much hope of getting the visa before 1st October. It'll take roughly 4 weeks to get through to London via the NVC so I guess he might have had his medical by mid-September. He'll then have to wait 4-6 weeks for an interview. So maybe end of October and his passport back by mid November? Click on my timeline and you can see how long ours has taken to date (and, looking at other timelines, this has been pretty average).

As others have said, the no. 1 rule of immigration is not to book ANYTHING until you have your visa in hand... good luck.

She's a bride to be she can call it a wedding if she wants to. People get married legally all the time and then have the party and they call the party their wedding. So why can't she do the same?

I actually think it's a great idea and even if he doesn't get his visa before October and has to go back home you know it won't be long before he comes back :) Smart thinking neaivj. It sucks not being able to plan a proper wedding so why not take control one way or another. Let me know how it turns out as I too will probably push back my interview to make things work with when we plan to get married.
