I canncelled the k1. thninking about it i dont want to go through the process again. My husband is a spiteful person and whose aim was to mess up my life. I am just going to get a visitor visa. I have proof I am not marriage. I have always been IN A good job. What issue would i have in getting the visa?

Wait, I thought you two were divorced??? It's obvious YOU are not committed to this man. Why not just give up all together? You're wasting everyone's time, including your own. Move on...

You mean a visitor Visa? Very hard? You have a denied petition on the books. What do you think immigration will think is the motive to come here. You would have to show good reason for returning.

Wait... So you originally applied for a CR1 Visa and got denied WITHOUT investigating why? If i were refused my visa you can be damn sure my husband and I would want to know why and try to correct the issue ASAP!

So moving on, you and your husband/ex-husband/fiancé want to go for a K1 visa for a hot minute, then you change your mind and want to get a simple visitor visa? Have you already started the K1 process? If so, i HIGHLY doubt they will grant you a visitor visa after a denied CR1 and a canceled K1 petition.

Am i the only one confused about this? Lol

Sounds like the CO was right and you are only concerned with coming to the US. Chances of a tourist visa are very low even with ties to your country. The returned spouse petition, divorce, and a cancelled fiancé petition with the ex-husband all sounds like immigration fraud.

We got divorced from 2012. He wanted us to be together but after reading and thinking about it, i refuse to get caught up in is mess again. He is spiteful and always threatening to cancelled visa process. He refuse to seek information on why the petition was denied and instead want to file k-1.He file divorced without letting me know. It wasn't until he came back to me that i know I was divorced. thats how the k-1 option came in. But since lastweek I called it off,


Sounds like the CO was right and you are only concerned with coming to the US. Chances of a tourist visa are very low even with ties to your country. The returned spouse petition, divorce, and a cancelled fiancé petition with the ex-husband all sounds like immigration fraud.

I have never file a k-1. I have never applied for a visa. I was only concern with travelling because the person I was inlove with reside there.

I dont know if i explain myself clearly. We never filed a k-1. the cr-1 was denied 2011. He didnt make the effort to follow up with them, He wasnot interested. He divorced in 2012 without letting me know. It wasnt until few weeks ago when he came back stating we should be together that I learnt of the divorced. Because I was still using his name and all. I never tried to get any visa prior to the cr-1 or after.

How did you cancel the K-1 if it was never filed. Do you mean you just told the USC to not file it and no paperwork was ever submitted?

You do still have in the system, and it will always been in the system, that a spousal visa petition was filed for you.

You can certainly apply for a visitor's visa but you will need strong, strong proof of ties to your home country and you will most likely be asked to explain about the abandoned spousal petition.

If he is a spiteful person that you say he is that wants to mess up your life and since you do not wish to pursue a K1,

I assume you do not wish to be in the relationship ..... so why visit ?

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
