All,

I just wanted to do a sense check regarding documents my fiancé should bring with her when she departs her home country (Russia). Of course she has her sealed K1 envelope along with all the documents we filed for the K1 petition including any translations. I just thought I would ask this august body for any suggestions relative to any other possibly obscure documents that we may need for the AOS as we plan to file that very soon after the wedding.

Thanks in advance.

Here's the AOS (from K1) guide: http://www.visajourney.com/content/k1k3aos

The first thing that comes to mind is for her to not forget her original or another certified copy of the birth certificate. This will become handy in the future, aside from AOS.

Also, not for AOS but for future job applications, I would suggest that she brings her university degree certificate/s or any other certifications and professional licenses, if any.

Sweet Cakes,

Thanks for the feedback and the link. I went to the government site and downloaded the current form. 864 is a bit confusing, especially parts 5 and 6. The instructions don't help a lot either. Do you know if I am the only household member sponsoring, do I need to file the 864a for myself per part 6 line 11, or am I covered on the 864 itself?

Just to clarify, are you asking if you still need to fill out an I-864a if you're the only sponsor [of your fiancee] in a household of which you're currently the only member? If so, no. You only need to fill out the I-864. The I-864a is only applicable for a spouse of a joint sponsor [if needed, as a member of their household].

Check out the example forms here for reference: http://www.visajourney.com/content/examples

-All the required AOS forms have examples there. You can follow how the I-864 example form is filled-out, that is if you're only sponsoring your fiancee, no other dependents and if you pass the 125% of the poverty guidelines. Otherwise, you also have to answer all the other applicable fields as well.

Thanks again for pointing me to the examples. These will help greatly. One last question (for now) on the i765 I assume the "current immigration status" would be I94 and not K1 as the example shows.

No, it's still K-1, as in the example form. Those questions (Qs #14 and #15) are technically asking for the visa used by the applicant in entering US.
